<br /> LORIN R. DOWNING and KAY J. DOWNING, husband and wife, herein called
<br /> Grantor, in consideration of the sum of One Dollar (S1 .001, receipt of which is hereby
<br /> acknowledged, hereby grants and conveys unto the
<br /> CITY OF GRAND ISLAND, NEBRASKA,
<br /> a municipal corporation in Hall County, Nebraska, herein called Grantee, a permanent
<br /> and perpetual easement and right-of-way to survey, construct, inspect, maintain,
<br /> repair, replace, relocate, extend, remove, and operate thereon, electric utilities and
<br /> appurtenances connected therewith, in, upon, above, along, over, across, underneath,
<br /> and through a part of Lot Forty Three (43), Bosselman Second Subdivision, in the City
<br /> of Grand Island, Hall County, Nebraska; the centerline of the twenty (20.0) foot wide
<br /> easement and right-of-way being more particularly described as follows:
<br /> Commencing at the northwest corner of Lot Forty Three (43),
<br /> Bosselman Second Subdivision; thence southerly along a curve, said
<br /> curve also being the easterly right-of-way line of Diers Avenue, a
<br /> distance of forty nine and thirty eight hundredths (49.38) feet to a point
<br /> of tangency; thence continuing along the easterly right-of-way line of
<br /> said Diers Avenue, a distance of fourteen and two tenths (14.2) feet to
<br /> the Actual Point of Beginning; thence deflecting left 50°28'54" from
<br /> the last described course and running southeasterly a distance of sixty
<br /> eight (68.0) feet.
<br /> The above-described easement and right-of-way containing a combined
<br /> total of 0.3 acres, more or less, as shown on the plat dated 10/22/99,
<br /> marked Exhibit "A", attached hereto and incorporated herein by reference,
