� 200000094 AGREEMENT FOR RESTRICTIVE COVENANTS The undersigned Judith K. Poland and Robert K. Poland, wife and husband, each in her and his own right and as spouse of the other (the Polands) , owners of the Servient Tract described upon Exhibit 1 to this Agreement do hereby covenant, promise and agree with Grand Island Area Economic Development Corporation (GIAEDC) owner of the Dominant Tract described upon Exhibit 1 to this Agreement as follows: 1 . On even date herewith Polands have sold the Dominant Tract to GIAEDC and as part of the consideration for that purchase have agreed to place the hereinafter stated restrictions and covenants upon the Servient Tract consistent with Buyer' s intended uses of the Dominant Tract as an industrial development subdivision. The restrictive covenants hereinafter stated shall run with the land and shall be binding upon the Polands and upon their respective grantees, successors, personal representatives, heirs and assignees (hereinafter referred to as Owner) and the tenants of each of them and may be enforced by any owner of any portion of the Dominant Tract. 2 . Neither an owner of the Servient Tract nor a tenant of an owner shall: (a) Object to or take any action intended to prevent annexation of the Servient Tract by the City of Grand Island; (b) Protest or take any other action intended to prevent the City of Grand Island from creating any improvement district or districts for paving, sanitary sewer, storm drainage, curb and gutter or sidewalks in which part or all of the Servient Tract is included; (c) Allow any uses of the Servient Tract which are not a Permitted Principal Use or a Permitted Accessory Use under Section 36-24 of the Grand Island City Code or apply for any Permitted Conditional Uses under that code section without the prior written approval of GIAEDC. 3 .
