� 200000094 <br /> AGREEMENT FOR RESTRICTIVE COVENANTS <br /> The undersigned Judith K. Poland and Robert K. Poland, wife <br /> and husband, each in her and his own right and as spouse of the <br /> other (the Polands) , owners of the Servient Tract described upon <br /> Exhibit 1 to this Agreement do hereby covenant, promise and agree <br /> with Grand Island Area Economic Development Corporation (GIAEDC) <br /> owner of the Dominant Tract described upon Exhibit 1 to this <br /> Agreement as follows: <br /> 1 . On even date herewith Polands have sold the Dominant <br /> Tract to GIAEDC and as part of the consideration for that <br /> purchase have agreed to place the hereinafter stated restrictions <br /> and covenants upon the Servient Tract consistent with Buyer' s <br /> intended uses of the Dominant Tract as an industrial development <br /> subdivision. The restrictive covenants hereinafter stated shall <br /> run with the land and shall be binding upon the Polands and upon <br /> their respective grantees, successors, personal representatives, <br /> heirs and assignees (hereinafter referred to as Owner) and the <br /> tenants of each of them and may be enforced by any owner of any <br /> portion of the Dominant Tract. <br /> 2 . Neither an owner of the Servient Tract nor a tenant of <br /> an owner shall: <br /> (a) Object to or take any action intended to prevent <br /> annexation of the Servient Tract by the City of <br /> Grand Island; <br /> (b) Protest or take any other action intended to <br /> prevent the City of Grand Island from creating any <br /> improvement district or districts for paving, <br /> sanitary sewer, storm drainage, curb and gutter or <br /> sidewalks in which part or all of the Servient <br /> Tract is included; <br /> (c) Allow any uses of the Servient Tract which are not <br /> a Permitted Principal Use or a Permitted Accessory <br /> Use under Section 36-24 of the Grand Island City <br /> Code or apply for any Permitted Conditional Uses <br /> under that code section without the prior written <br /> approval of GIAEDC. <br /> 3 . The Owner of the Servient Tract shall : <br /> A. Comply with the off street parking requirements <br /> set forth in Section 36-35 of the Grand Island <br /> 1 <br />
