Each undersigned Borrower has agreed to act as Trustor �`5-S <br /> in the DEED OF TRUST to which this writing is the Preface and o <br /> wherein ALICE L. EADES, TRUSTEE, is the Beneficiary and which is <br /> hereinafter referred to as the Trust Deed. <br /> 2 . Each undersigned Borrower knows that by virtue of the <br /> statutes of the State of Nebraska each Borrower has the right to <br /> make a Designation of Homestead in the body of the Trust Deed. <br /> 3. EACH UNDERSIGNED BORROWER DOES HEREBY DISCLAIM THE <br /> RIGHT TO MAKE A DESIGNATION OF HOMESTEAD IN THE BODY OF THE TRUST <br /> DEED. <br /> 4 . Each undersigned Borrower does hereby state that no <br /> part of Borrower' s homestead is presently or in the future will <br /> be situated upon the real estate described in the Trust Deed. <br /> Each undersigned Borrower understands this to mean that whether <br /> or not each undersigned Borrower is presently residing upon the <br /> real estate described in the Trust Deed and whether or not each <br /> undersigned Borrower hereafter establishes residence and a <br /> homestead upon any part of that real estate during the time that <br /> the Trust Deed remains unsatisfied and a lien upon the real <br /> estate, EACH UNDERSIGNED BORROWER SHALL HAVE NO RIGHT TO MAKE A <br /> DESIGNATION OF HOMESTEAD in the event of Trustee' s sale under the <br /> power of sale contained in the Trust Deed. <br /> 5. EACH UNDERSIGNED BORROWER DOES HEREBY WAIVE BY THIS <br /> WRITTEN ACKNOWLEDGMENT ANY AND ALL RIGHT TO MAKE A DESIGNATION OF <br /> HOMESTEAD UPON ANY PART OF THE REAL ESTATE DESCRIBED IN THE TRUST <br /> DEED. Each undersigned Borrower understands that the execution <br /> of this acknowledgment constitutes the waiver of rights otherwise <br /> available for the purpose of affording Borrower the opportunity <br /> to retain Borrower' s homestead in the event of a default upon the <br /> Trust Deed. <br /> 6.
