A Notice of Lease Agreement ( "Notice ") was originally recorded in the Office of the Hall <br />County Register of Deeds on November 2, 2006 as Document No. 200609797. <br />2. The real estate affected by such Notice was described as: <br />Menards Second Subdivision, Lot seven (7) and the north one hundred thirty <br />five feet (N135') of Lot eight (8), in the City of Grand Island, Hall County, <br />Nebraska except any part thereof in road, street or alley and subject to any and <br />all matters of record or which would be discovered by an accurate survey and <br />inspection of the premises. ( "Real Estate ") <br />3. In March, 2008, Sundance Feed & Seed Company ( "Tenant "), vacated the Real Estate <br />and Tenant thereafter ceased all business operations. <br />4. Consistent with the provisions contained in the Lease Agreement dated October 12, 2006 <br />( "Lease "), when the Tenant vacated the Real Estate, Southeast Crossings, L.L.C. <br />( "Landlord ") elected to treat such act as an early termination of that Lease. <br />5.
