Nov. 4, 2015 By: n ° O O 0 DEED OF TRUST SUBORDINATION AGREEMENT This agreement is made this 7 day of November, 2014 by and between Henderson State Bank ( "Lender ") and Farm Credit Services of America, FLCA ( "Bank "). Lender is the beneficiary under a Deed of Trust (the "Junior Deed of Trust ") granted by Ken Kohlhof aka Kenneth A. Kohlhof, a single person, Trustors to Henderson State Bank dated June 10, 2011 and recorded in the office of the Register of Deeds, Hall County, Nebraska on June 14, 2011 as Instrument No. 201104430 encumbering the real property described therin (collectively, the "Property"). Bank is the beneficiary under a Deed of Trust (the "Senior Deed of Trust ") dated October 9, 2014 and recorded in the same office on October 28, 2014 as Instrument No. 201406803 encumbering the property described herein. To induce Bank to make a loan to the Borrower secured by the Senior Deed of Trust, Lender has agreed to execute and deliver this Subordination Agreement. ACCORDINGLY, in consideration of the premises and for other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, Lender hereby agrees with Bank that the lien of the Junior Deed of Trust on the Property is and shall be and remain fully subordinate for all purposes to the lien of the Senior Deed of Trust on the Property, to the full extent of all sums from time to time secured by the Senior Deed of Trust; provided, however, that the total indebtedness secured by the Senior Deed of Trust does not exceed $127,500.00 exclusive to interest thereon, amounts advanced to protect the lien and priority of the Senior Deed of Trust, and costs of collection. Part of the Northeast Quarter (NE%) of Section 4, Township 12 North, Range 11 West of the 6th P.M., Hall County, Nebraska, mare particularly described as follows: Commencing at the Northeast corner of the Northeast Quarter (NE'/) of Section 4; thence running westerly along and upon the North line of Section 4 a distance of 965 feet to the actual point of beginning; thence running southerly parallel to the easterly boundary line of said Section 4 a distance of 594 feet thence running Westerly parallel to the Northerly boundary line of said Section 4 a distance of 396 feet; thence running northerly parallel to the easterly boundary line of said Section 4 a distance of 594 feet to the North line of Section 4, Township 12 North, Range 11 West of the 6th P.M., thence running Easterly along and upon the Northerly line of said Section 4 a distance of 396 feet to the point of beginning.
