"Security Instrument" means this document, which is dated November 12, 2014, together with all riders <br />to this document. <br />2. "Borrower" is Shawn Kelley, a married person. Borrower is Trustor under this Security Instrument. <br />3. "Lender" is Alan Giebel, a single person. Lenders' address is N38483 Ehrat Lane, Whitehall, Wisconsin, <br />54773. Lender is the Beneficiary under this Security Instrument. <br />4. "Trustee" is Derek Terwey, Attorney at Law #24230, 422 N Hastings Ave., Suite 101, Hastings, Nebraska <br />68901. <br />5. "Note" means the promissory note signed by Borrower and dated November 12, 2014. The Note states <br />that Borrower owes Lender One - Hundred - Fifteen - Thousand Dollars ($115,000.00) without interest. <br />Borrower has promised to pay this debt on the date when said property is transferred or sold by the <br />Trustor. <br />6. "Property" means the property that is described below under the hearing "Transfer of Right in the <br />Property." <br />7. "Loan" means the debt evidenced by the note, without interest, any prepayment charges and late <br />charges due under the Note, and all sums due under this Security Instrument, without interest. <br />8. "Riders" means all Riders to this Security Instrument that are executed by Borrower.' The following Riders <br />are to be executed by Borrower (check box as applicable). <br />❑ Second Home Rider <br />❑ Other(s)[specify] <br />9. "Applicable Law" means all controlled applicable federal, state and local statutes, regulations, ordinances <br />and administrative rules and orders (that have the effect of law) as well as all applicable final, non - <br />appealable judicial opinions. <br />10. Successor in Interest of Borrower" means any party that has taken title to the Property, whether or not <br />that party has assumed Borrower's obligations under the Note and /or this Security Instrument. <br />
