Bredthauer Stelling died on June 28, 2014; <br />-. <br />� C.U) <br />/ C '+ 7 � ---i <br />r <br />r- M <br />C --, rn <br />a <br />rT n <br />rn h <br />-> , <br />--i -0 1-:. w <br />rn <br />r :v <br />r 4 � <br />w `.. . <br />The East Half (E' /2) of Lot Two (2) of Stehr's Subdivision located in the West Half of the Southwest <br />Quarter (W''SW') of Section Eleven (11), Township Eleven (11) North, Range Nine (9) West of the 6th <br />P.M., Hall County, Nebraska; and <br />Part of Lot Twelve (12) of Stehr's Subdivision located on a part of the West Half of the Southwest Quarter <br />(W' /2SW'/) of Section Eleven (11), Township Eleven (11) North, Range Nine (9) West of the 6th P.M., in <br />Hall County, Nebraska, more particularly described as follows: <br />Commencing at the Southwest Corner of said Lot Twelve (12) and running thence east along the South <br />boundary line of said Lot for a distance of Fifty (50) feet; running thence north parallel with the West <br />boundary line of said lot to a point where the Northerly boundary line of said lot intersects the Southerly <br />boundary line of Federal -State Highway #30; and running along southwesterly on the Northerly boundary <br />line of said lot to the Northwest corner of said Lot Twelve (12) and running thence southerly along and <br />upon the Westerly boundary line of said Lot Twelve (12) for a distance of 153.5 feet to the place of <br />beginning, subject to the right -of -way, grant, easements, and restrictions of record. <br />Larry D. Bredthauer, being first duly sworn upon oath, deposes and states that: <br />1. Clarice K. Bredthauer Stelling created the Clarice K. Bredthauer Stelling <br />Revocable Living Trust Agreement dated January 26, 1995 as amended May 15, 2003, (the <br />"Trust Agreement ") wherein she designated herself as the initial Trustee of the Trust Agreement, <br />Larry D. Bredthauer as the first successor Trustee, and Five Points Bank, Grand Island, Nebraska <br />as the further successor Trustee; <br />2. By Warranty Deed dated January 26, 1995 and recorded with the Office of Hall <br />County Register of Deeds as Document No. 95- 100587, Clarice K. Bredthauer Stelling conveyed <br />the real estate described in said Deed and also as disclosed hereinabove to herself as Trustee of <br />an undisclosed Trust. Affiant states that said Deed was intended to convey the ownership of said <br />real estate to Clarice K. Bredthauer Stelling as Trustee of the Clarice K. Bredthauer Stelling <br />Revocable Living Trust Agreement dated January 26, 1995 and subsequently amended May 15, <br />2003; <br />3. From the date of the creation of the Trust until June 28, 2014, Clarice K. <br />Bredthauer Stelling served as Trustee of the Trust; <br />5. Under date of July 21, 2014, Affiant Larry D. Bredthauer executed an Acceptance <br />of Trusteeship wherein he accepted the Trusteeship of said Trust Agreement and agreed to <br />administer said Trust in accordance with the terms of said Trust Agreement and the laws of the <br />State of Nebraska; <br />
