r" <br />f- <br />X c <br />4) <br />DEED OF TRUST <br />THIS DEED OF TRUST is dated the day of October, 2014. The Trustors are TOBY R. <br />SCHNECKLOTH and KIMBERLY A. SCHNECKLOTH, husband and wife, whose address is 3114 <br />West 14 Street #2, Grand Island, Nebraska 68803 ("Trustors"). The Trustee is DAVID A. <br />CHRISTENSEN, attorney -at -law and member of the Nebraska State Bar Association, whose address is <br />11605 Miracle Hills Drive, Suite 300, Omaha, Nebraska 68154 ( "Trustee "). The Beneficiary is <br />JOANNE E. WHEARTY, whose address is 10910 South 18 Street, Bellevue, Nebraska 68123 <br />( "Beneficiary "). Trustors owe Beneficiary the principal sum of One Hundred Thousand and No /100 <br />Dollars ($100,000.00). This debt is evidenced by a Contract for Deed dated August 11, 2014, by and <br />between Trustors, as Maker, and Beneficiary, as Lender (the "Note). Said Note provides for payment <br />of the principal sum, together with interest at a rate of 1.00% per annum, in one hundred eighty (180) <br />equal monthly installments of principal and interest in the sum of Five Hundred Ninety -eight and <br />49/100 Dollars ($598.49), commencing on the first day of September 2014, and continuing on the <br />first day of each month thereafter through and including the first day of August 2029, at which time <br />the entire remaining balance, together with accrued interest thereon, shall be paid in full. This Deed <br />of Trust secures to Beneficiary: (a) the repayment of the debt evidenced by the Note, with interest, and <br />all renewals, extensions and modifications; (b) the payment of all other sums, with interest, advanced <br />under Section 6 to protect the security of this Deed of Trust; and (c) the performance of Trustor's <br />covenants and agreements. For this purpose, Trustors irrevocably grant and convey to Trustee, with <br />power of sale, real estate located at 3114 West 14 Street #2, Grand Island, Nebraska 68803, and <br />legally described as follows: <br />Unit Six (6), Ravenoaks Condominium, in the City of Grand Island, Hall County, <br />Nebraska, a Condominium in Accordance with the Amended Master Deed and <br />Declaration recorded on April 3, 2000, under Document No. 200002611 of the <br />County of Hall, State of Nebraska, <br />together with all the improvements now or hereafter erected on the above- described property, and all <br />easements, rights, appurtenances, rents, royalties, mineral, oil and gas rights and profits, water rights <br />and stock and all fixtures now or hereafter a part of the property. All replacements and additions shall <br />also be covered by this Deed of Trust.
