Re�ati�nship tv First Security Instrument. <br /> �a} Second Security Instrument. In order to secure payments which the Secretary may make to or <br /> on b�half af Borrower pursuapt to Section 2SS�i��1��A}af�h��National Housing Act and the Laan <br /> Agreement,the Secre�ary has required Borrovver to execute�:�Second Note and this S�cond <br /> Security �nstrumen�. Borrow�r alsa has executed a First N�t��and First Security �nstrument. <br /> (b}Relat�onship of Fir�t and Secand Security Instrumen#s. Payments made by�he Secretary <br /> shall n�t he included in the debt under the First Note unless: <br /> �i}The First Security Instrum�nt is assigned to�he Secretary; or <br /> (ii}Tl1e Secretary accepts reimbursement by the holder c�f the First Note for a1l payments made <br /> by the Secretary. <br /> If the circumstances described in�i}or�ii}occur,then ai l payments by�he Secretary, inc�uding <br /> inter�st on the payments bu��xcluding late charges paid by the Secretary, shall be included �n <br /> the deb�under the First Note. <br /> (c}Effect�n Borrawer. 'Where th�re i s no assignment or rei mbursement as described in�b}�i}ar <br /> (�i}and the Secretary makes payments to Borrower,then Borrower sha11 not: <br /> �i� Be r�quired to pay amounts owed under the First Notf:,Qr pay any rents and re�enues of the <br /> Property under Paragraph 2D to the holder of the First Nc�te or a recei�er of the Pr�perty, unt�l <br /> the Secretary has required payment--in-fuil of a�l outstancling principal and accrued �nteres� <br /> under th�Second No�e; or <br /> �ii� Be obligated t� pay interest or shared appreciation under�he F�rst Not�at any�ime, <br /> whether accrued bef�re or after the payments by the Secretary,and whether or n�t a�crued <br /> interes�has been included iri the principal balance under�he First No�e. <br /> (d�No Duty of�he�ecretary.
