I'I z. 213 <br /> ASSIGNMENT OF MORTGAGE: KNCW ALL MEN BY THESE PRESENTS: That I, Solomon Cstheimer the <br /> party of the first cart, in consideration of the sum of Five Thousand Ten and 26-100 <br /> ($5010 28) Dollars, lawful money of the United States of America: , to me in hand paid <br /> by Straus Brothers Company of Chicago, Illinois, the party of the second part, at or be- <br /> fore the ensealing and delivery of these presents, the receipt whereof is hereby acknow- <br /> ledged, have granted, bargained, sold, assigned, transferred, and set over, and, by these <br /> Presents, do grant, bargain, sell, assign, transfer, and set over unto the said partif <br /> the second part, its heirs, executors, administrators, assigns, a certain Indenture of <br /> Mortgage, bearing date the 19th day of July, in the year one thousand nine hundred <br /> and nine, made by Anna Koehler, and all my right , title and interest to the premises there- <br /> in described , as follows , to-wit : A certain tract of land situate in the County of Hall <br /> and State of Nebraska, known as the East half (Ei) of the South-west quarter (SW ) of <br /> Section Fifteen (15) Township Eleven (11) , Range Nine (9) West of the Sixth (6th) Princi- <br /> pal Meridian , except two and one half (2i) acres described as follows: Commencing at the <br /> North-west corner of said 80 acres, running thence south 80 rods, thence east 2 rods, <br /> thence north 40 rods; thence east 6 rods, thence north 40 rods, thence west 8 rods to <br /> place of beginning. Also lot Fourteen (14) in the County Sub-division of the West half <br /> of the South-west quarter of said Section 15, containing 25 3-4 acres; also lot (18) <br /> eighteen in the County Sub-division of the West half of the South'_- west quarter of said <br /> section 15 and containing 10-- acres and also described as follows: to-wit:. Commencing <br /> at a point 33-i rods north of the south-west corner of said Section 15 running thence <br /> north 42 2-3 rods, thence east 40 rods,thence south 40 rods, thence west 18 rods; thence <br /> South 20 rods, thence West 4 rods, thence north 17 1-3 rods, thence west 18 rods, to the <br /> place of beginning, which said mortgage is recorded in the recorder' s office of the <br /> County of Hall in the State of Nebraska, in Rook No. 38 of Mortgages, at page 393. <br /> Together with the notes therein described, and the money due or to grow due thereon, <br /> with the interest, to have and to hold the same unto the said party of the second part, <br /> its executors, administrators, or assigns, forever: subject only to the provisos in the <br /> said Indenture of Mortgage contained; And I do, for my heirs , executors, and administrators <br /> covenant with the said partof the second part, its heirs, executors, administrators, and <br /> assigns, that there is now actually owing on said notes and Mortgage, in principal <br /> Five Thousand ten and 28-100 Dollars, and interest, thereon and that I have good right <br /> to assign the same; And I do hereby make, constitute, and appoint the said party of the <br /> second part, my true and lawful Attorney, irrevocably, in my name, or otherwise, but at <br /> its own proper costs and charges, to have, use, a d take all lawful ways and means for the <br /> recovery of the said money and interest, and, in case of payment , to discharge the same <br /> as fully as I might, or could do, if these presents were not made. <br /> In Witness Whereof, I have hereunto set my hand and seal, this ninth day of August, <br /> year <br /> in the^one thousand nine hundred and nine . <br /> Solomon Ostheimer.
