<br /> Fred M. Penney, which is recorded in Book 31 of Mortgages, page 446 of the records of
<br /> Hall County, Nebraska. Witness my hand this 26th day of June, 1909.

<br /> ASSIGNMENT OF MORTGAGE: KNOW ALL NEN BY THESE PRESENTS: That I Frank H. Penney, surviv-
<br /> ing partner of firm, Penney & Son; of the first part, in consideration of the sum of
<br /> Eighteen Hundred 00-100 Dollars, to me in hand paid by F. M. Penney, of the second part,
<br /> the receipt whereof is hereby acknowledged, have sold, and by these presents do sell,
<br /> assign, and transfer unto the said party of the second part a certain Indenture of Mort-
<br /> gage bearing date the 1st day of April in the year 1906, made by Patrick W. and Mary
<br /> Francis in favor of Penney & Son, and conveying all of the North one-half of the north-east
<br /> quarter of Section twenty-four, Township Ten, North of Range Twelve (12) , West of the 6th
<br /> P.M. containing 80 acres excepting ther-from: 15-77-100 Acres deeded to Frederick L.
<br /> Oswald by Warranty Deed dated April 21, 1898 and recorded in Book 22, page 403 and
<br /> it
<br /> excepting therfrom 5 acres deeded to Bohn M. Tyrrell by Warranty Deed dated Sept . 12, 189d1 and
<br /> recorded in Deed Book 28, page 136 of Hall County, Nebraska, records, in Hall County, in
<br /> the State of Nebraska, and which said Mortgage was recorded in the records of said County,
<br /> on the 24th day of April, in the year 1906 in Book 31 of Mortgages, at page 446,together
<br /> with the notes or obligations therein described, without recourse on me in any event or for
<br /> any cause: To Have and To Hold the same unto the said party of the second part , his
<br /> executors, administrators, or assigns, subject only to the provisos in the said Indenture
<br /> of Mortgage contained. In Witness Whereof, I have hereunto set my hand and seal this
<br /> 21st day of September, in the year One Thousand Nine Hundred Eight .
