<br /> RELEASE OF REAL ESTATE MORTGAGE.
<br /> KNOW ALL MEN BY THESE PRESENTS: That upon February 15, 1907 , William B. Waite and
<br /> Cora A. Waite , his wife in consideration of a loan of Twenty-two hundred dollars did
<br /> convey by a real estate mortgage to A. H. Held, and C. F. Bentley, Executors the North east
<br /> quarter ( Na ) of section twenty three (23) in Township Twelve ( 12) North of Range Twelve
<br /> ( 12) west of the Sixth Principal Meridian, in Hall County, Nebraska, which said mortgage
<br /> was recorded in the office of the County Clerk of Hall County, Nebraska upon the `"20th
<br /> day of February, 1907 in Book No. 31, of Mortgages at brage 498. That the said A . H. Held
<br /> and C. F. Bentley Executors named above were the duly appointed and acting executors under
<br /> the last will and testament of H. C. Held, deceased which case is still pending in the
<br /> County Court of Hall County, Nebraska. That said last named parties had no personal right
<br /> title , interest or claim inand to said property, but only an interest therein by virtue
<br /> of said official position held by them. That upon the 15th day of July 1908 , the said
<br /> C. F. Bentley, above named, died and his estate has been probated in Hall County, Nebraska.
<br /> That his executrix Angeline A. Bentley filed a full, complete and final report of all his
<br /> doings as Executor of the H. C. Held Estate, listing this mortgage in said report as the
<br /> property of the H. C. Held estate and asking that the estate of C. F. Bentley be dis-
<br /> charged from all further connection therewith which report was duly recorded and made a
<br /> part of the proceedings in said case by the County Judge. That thereupon A. H. Held,
<br /> I - became the sole Executor of the Estate of said H. C. Held having sole right to discharge
<br /> all obligations against said estate, no successor to C. F. Bentley, ever being appointed.
<br /> Now Therefore, in consideration of the pment of the debt of twenty-two hundred dollars,
<br /> within named, as sole executor of the estate of H. C. Held deceased, I do hereby release
<br /> the mortgage made by William B. Waite and Cora A. Waite his wife , to A. H. Held, and
<br /> C. F. Bentley, Executors on the property herein above described which mortgage was duly
<br /> recorded as above set out in this release. v7itness my hand this 4 day of February, 1909.
