CO <br />r ". w_ 0 u-> r� <br />--1 <br />G <br />THIS DECLARATION OF RESTRICTIONS (this "Declaration ") is made as of this <br />' day of O 4 , 2014 ( "Effective Date "), by MID - COUNTRY TRADING, <br />L.L.C., a Nebraska limited liability company, with a business address of 2502 A North Webb <br />`Road, P.O. Box 139, Grand Island, Nebraska 68803 ( "Declarant "). <br />WHEREAS, Declarant is the owner of that certain parcel of real property situate in the <br />City of Grand Island, County of Hall, State of Nebraska, which is more particularly described in <br />Exhibit A attached hereto and made a part hereof (the "Declarant Parcel "). The boundary of <br />the Declarant Parcel is outlined on Exhibit B; <br />WHEREAS, Grand Island Joint Venture, LLC, a Missouri limited liability company <br />( "Landlord "), is the owner of those certain parcels of real property situate in the City of Grand <br />Island, County of Hall, State of Nebraska, which are approximately bounded on the north by W. <br />Capital Avenue, on the south by State Street, on the east by Webb Road and on the west by <br />Highway 281 (collectively, the "Shopping Center Parcels "); <br />WHEREAS, Landlord has leased, or will lease, a portion of the Shopping Center Parcels <br />to DSG [as hereinafter defined] (the "DSG Lease "). The portion of the Shopping Center Parcels <br />leased to Dick's Sporting Goods, Inc. ( "DSG ") is hereinafter referred to as the "DSG Premises"; <br />WHEREAS, as a condition for DSG to lease the DSG Premises, Declarant has agreed to <br />encumber the Declarant Parcel with certain use restrictions set forth herein; and <br />WHERAS, a member of Declarant owns an ownership interest in Landlord, and such <br />member of Declarant will benefit from the DSG Lease, and desires to encumber the Declarant <br />Parcel in the manner hereinafter set forth. <br />NOW, THEREFORE, for consideration of Ten Dollars ($10.00) and for other good and <br />valuable consideration, the receipt and legal sufficiency of which is hereby acknowledged, and <br />intending to be legally bound hereby, Declarant declares for the benefit of the Declarant as well <br />as the owner(s) of the Declarant Parcel, the owner(s) of the Shopping Center Parcels and the <br />
