STATEMENT OF PURPOSE. The purpose of this License Agreement is to set forth the terms and conditions under which the Licensee may construct, maintain, repair, and utilize the following described improvement which will infringe upon the public right -of -way of the Licensor: To install at a minimum a 15" RCP concrete p lunder the driveway at 3812 W 13 Street, by the City's Street Division. 2. DESCRIPTION OF LICENSEE'S REAL ESTATE. The Licensee owns the following described real estate subject to the Licensor's public utility easement to which this License Agreement shall apply: THE EAST HALF OF THE SOUTHWEST QUARTER (E 1/2 SW %) IN SECTION TWELVE (12), TOWNSHIP ELEVEN (11) NORTH, RANGE TEN (10) WEST OF THE 6 P.M., HALL COUNTY, NEBRASKA EXCEPT A TRACT MORE PARTICULARLY DESCRIBED IN DEED RECORDED IN THE REGISTER OF DEEDS OFFICE IN BOOK 150, PAGE 349; EXCEPT A TRACT MORE PARTICULARLY DESCRIBED IN WARRANTY DEED RECORDED IN THE REGISTER OF DEEDS OFFICE AS DOCUMENT NO. 84- 004889; EXCEPT A TRACT MORE PARTIpLARLY DESCRIBED IN WARRANTY DEED RECORDED IN THE REGISTER OF `DEEDS OFFICE AS DOCUMENT NO. 85- 000755 AND EXCEPT A TRACT MORE PARTICULARLY DESCRBIED IN THE REGISTER OF DEEDS OFFICE AS DOCUMENT NO. 94- 100669. 3. LICENSEE'S DUTIES AND RISKS. It is understood and agreed that the Licensee may construct, maintain, repair and utilize the above described improvement at the Licensee's sole risk. The Licensee hereby waives any claim for damages against the Licensor, its officers, employee, agents and independent contractors for any damage or injury that may result to said improvement.
