The real property <br /> encumbered by the Security I r�strument is described on Schedule 2 attached hereto and <br /> incorparated herein by this reference�the "Land"}, and the Security Instrument also encumbers <br /> the healthcare facility that is operat�d on the Land and authorized to recei�e insured mortgage <br /> financing pursuant to Section �32 of the National Housing Act, as amended or any subseauent <br /> legislat�on��ollecti�ely and indi�idually"Health�are Facility"}and any other impro�ements <br /> situated on the Land �coliecti�ely and individually "Improvements"}, �the Land,t�e Heaithcar� <br /> Facil�ty, ar�d any other Imprvvements,tog�ther with ar�y and all assets of whate�er nature or <br /> where�er situat�d related to the Loan, are h�reinafter sometimes referred to as the"Proj�ct"}. <br /> The Note is b�in� insured by the Federal Hausing Administration �"FHA"}, an organizational <br /> unit of the United States I]�partmer�t of Hausing and Url�an D���lopment("HUD"} under the <br /> pro�isions �f Section 232 of the National Housing Act and the regulations promulgated <br /> thereunder; and <br /> �VHEREAS, Borrower and Master Tenant ha��entered into that cer�ain unrecarded <br /> Master Lease, dated as of July 1,Z014,as amended l�y that��rtain unrecorded Joinder to <br /> Master Lease; dated as of July 1,2U14, as amended by that certain unrecarde� Sec�nd _ <br /> Joinder ta Master LeaS�, dated as of e�en date herewith �as the same may be amend�d from <br /> time to time,the"Master Lease"}, relating to the Healthcare Facility for the term and upon the <br /> conditions set forth therein; and <br /> �VHEREAS, Master Tenant and�ach �perator have entered into a sub�ease relating to <br /> such �perator's operation of a Hea�thcare Facility, far the term and upon the conditions set forth <br /> therein (each a"Subl�ase"�; and <br /> WHEREAS, Master Tenant and each �peratar are�ach executing a r�gulatory agreem�nt <br /> in fa�or of HUD in connection with the Loan (each as the same may be amended, modif ed <br /> andlor restated, fram time to time, respectively, a"Master Tenant R�gulatory Agreem�nt"and <br /> an"�perat�r Regulatory Agr�ement")which are being recorded against the Project; ar�d <br /> WHEREAS, in connection with the Loan, each Borrower and HUD entered into a <br /> Healthcare Reguiatary Agreement- Borrawer,which agreement is bein�recorded against the <br /> Pr�ject�as the same may be amended, madified andlor restated, fram time to time,the <br /> "Borrower Regulatory Agre�mer�t"�.
