F�RBEARAN�E. <br /> (a} So long as the Lnan is insured by HUD, Lender sha�l not without obtaining the <br /> prior written consent of HUD,take any of the following actior�s: �xtend the time far payment of <br /> al1 or an�part af the Indebtedness; reduc�the payments due under this Se�urity Instrument or th� <br /> Note; release anyane liable far the payment of any amounts under this Se�urity�nstrument or the <br /> Note; accept a renevval of the Note; modify the terms and time of payment of the Indebtedness; <br /> jain in any extension or subordination agreement; rel�ase any Mortgaged Proper�y;take or <br /> re lease other or additional security; modify the rate of interest or periad of amortizati�n of the <br /> Note or change the amount of th�monthly installments payable under the Note; and otherwise <br /> modify this Security Instrument or th�Not�. Hovve�er, if the Contract of Insurance has been <br /> terminated, Lender may�but shall not be obligated to�agree with Borrovver to any of the <br /> aforementioned actions in this Section and Lender shall not ha�e to give Natice to or o�tain the <br /> consent of any guarantor or third-party abl�gar. <br /> �b} Any forbearance�y Ler�der in exercising any right or remedy under the Note,this <br /> Security Instrument, or any other L�an Document or�therwise afforded by appl�cable law, shall <br /> not�e a wai�er�f or preclude the exercis�of any right or remedy. The acceptance by Lender�f <br /> payment of all or any part of the Indebtedness after the due date of such payment, or�n an <br /> amount that is less than the r�quired paym�nt, shall not be a wai�er of Lender's right to require <br /> prompt payment when du� of a11 other payments �n account nf the Indebtedness or to exercise <br /> any right ar remedy for ar�y failure to make prompt pa�ment. Enforcement by Lender of any <br /> security for the Ir�debtedness sha11 n�t constitute an�lection by Lender of remedies so as to <br /> preclude the exercise of any ather right available to Lender. Lender's receipt�f any proceeds ar <br /> awards under Section 19 and Section 2U shall n�t operat�to cure or waive any E�ent of Default. � <br /> 25. L�AN �HARGES. If any applicable law�imiting the amount of interest or <br /> other charges permitted to be collected fram Borrower in connectinn with the L�an is interpreted <br /> sa that any interest�r other charge pra�ided for in any Laan Document, whether considered <br /> separately ar together with ather charges pro�ided for in any Loan D�cument, v�olates that la�v, <br /> and Borrower is entitled to the benefit of that Iaw, that interest or charge is hereby reduced to the <br /> extent necessary to eliminate that�i�latian. The amounts, if any, pre�inusly paid to Lender in <br /> excess of the permitt�d amounts sha11 be applied by Lender to reduce the principal �f the <br /> Indebtedness. For the purpose of determining whether any appiicable law �imiting the am�unt of <br /> interest or other charges permitted to be collected from Borrower has been violated, all <br /> Indebtedness that�onstitutes interest, as well as all ather charges made in connection with the <br /> �ndebtedness that constitute interest, shall be deemed to be ailacated and spread ratab�y o�er the <br /> stated term of the Note. Un�ess otherwise required by app�icahle law, such ailocation and <br /> spr�ading sha11 be effected in such a manner that th�rate of interest so computed is uniform <br /> throughnut the stated term af the Note. <br /> 25. WAIVER�F STATUTE �F LIMITATI�NS.
