<br /> �'I. Hazard�us Substan�es. As used in this Section 21: (a} "Hazardous Substancest'are those
<br /> � substances defined as toxic or hazardaus substances,pallutants,or wastes by En�ironmental Law and
<br /> the fallowing substances:gasoline,kerosene,other flammable ortoxic petroleum products,toxic pesticides
<br /> and herbicides,�olatile sol�ents,materials containing asbestos or formaldehyde,and radioacti�e materials;
<br /> �b} "En�ironmental Lawt'means federal laws and.laws of the jurisdiction where the Property is located
<br /> that relate to health, safety or en�ironmental protection;�c} "En�ironmental�leanup" includes any
<br /> response action, remedial action,or remo�al action,as defined in En�ironmental Law;and�d}an
<br /> "En�ironmental�ondition"means a condition that can cause,contribute to,or otherwise trigger an
<br /> En�ironm ental �leanup.
<br /> Borrower shall not cause or permit the presence,use,disposal, storage,or release of any Hazardous
<br /> Substances,or threaten to release any Hazardous Substances,on or in the Property. Borrower shall not
<br /> d�,n�r alla�an}�ane else ta da,anything afFecting the Praperty(a}that is in�iolatior�of any Er��iror�m�r�tal
<br /> Law,(b}which creates an En�ironmental�ondition,or(c}which,due to the presence,use,or release of
<br /> a Hazardous Substance,creates a condition that ad�erse�y affects the�alue of the Property.The preceding
<br /> tvr�a senten�es shall nat apply ta the presence,use,ar storage on th�Property of small quantiti�s of
<br /> Hazardous Substances that are generally recognizeci to be appropriate to normal residential uses and to
<br /> maintenance of the Property(�ncludin�,but not limited to,hazardous substances in consumer products}.
<br /> Borrower shall promptly gi�e Lender writ�en notice of(a}any in�estigation,claim,demand, lawsuit or
<br /> other actior�by any go�ernmental or regulatory agency or pri�ate party in�ol�ing the Property and any
<br /> Hazardous Substance or En�ironmental Law of which Borrower has actual knowledge,�b}any
<br /> En�ironmer�tal �ondition, including but not limited to,any spilling, leal�ing,discharge,release or threat
<br /> of release of any Hazardous Substance,and(c�any condition caused by the presence,use or release of
<br /> a Hazardous S ubstance which ad�ersely affects the�alue of the Property.If Borrower learns,or is notified
<br /> by any go�ernmental or regulatory authority,or any pri�ate party,that any remo�al or other remediation
<br /> of ar�y Hazardous Substance affecting the Property is necessary,Borrower shall promptly take all necessary
<br /> remedial acti�ns in accordance with En�ironmental Law.Nothing herein shall create any obligation on
<br /> Lender for an En�ironmental�leanup.
<br /> N�n-Unif�rm C��enants. Borrower and Lender further co�enant and agree as follows:
<br /> ��. A��elerati�n; Remed ies. Lender shall giye notice to Borrower prior to acceleratian
<br /> following Borrower�s breach of an� co�enant or agreement in this Security Instrument (but
<br /> not prior to acceleration under Section 18 unless Applicable Law prvvides otherwise}. The
<br /> notice shall specify: (a} the default; (b} the action required to cure the default; (c} a date, not
<br /> less than 3D days from the date the notice is gi�en to Borrower, by which the default must �
<br /> be cured; and (d� that failure ta �ure the defau�t on �r �efare the date specified in the not�ce
<br /> may result in acceleration of the su ms secu red by this Secu rity Instru ment and sale of the
<br /> Property, The notice shall further inform Borrvwer of the right to reinstate after acceleration
<br /> and the right ta �ring a caurt actian to assert the non-existence of a de�ault ar any oth�r
