Mutual Release of Right of First Refusal Dated November 25, 2003 Recorded at 200400 188 This Mutual Release of Right of First Refusal is made and entered into the date last placed below by and between Triangle Plaza, LLC, a Wisconsin Limited Liability Company, by its successor in interest, the Trustees of the Donald J. Hoeller and Bernadette V. Hoeller Revocable Living Trust dated February 29, 1988 (Trustees) and Steve Duennerman (Duennerman) Whereas on November 25, 2003 Triangle Plaza, LLC, a Wisconsin Limited Liability Company and Steve Duennerman ( "Duennerman) entered into a right of first refusal giving Duennerman the right to purchase property located at 2004 N. Webb Rd., Grand Island, Nebraska, legally described as Replat of Lot Eight (8), Grand Island Mall Eighth Subdivision in the City of Grand Island, Hall County, Nebraska, (Grand Island Property) on the terms described therein; and, Whereas in or about March, 2011, the Managing Members of Triangle Plaza, LLC, Donald J. Hoeller and Bernadette V. Hoeller transferred the Grand Island Property to The Donald J. Hoeller and Bernadette V. Hoeller Revocable Living Trust dated February 29, 1988, and; Whereas the Trustees no longer desire to sell the Grand Island Property to Duennerman and Duennerman no longer desires to purchase the Grand Island Property. NOW THEREFORE, Triangle Plaza, LLC, by its successor in interest, the Trustees of the Donald J. Hoeller and Bernadette V. Hoeller Revocable Living Trust Dated February 29, 1988 and Steve Duennerman, mutually release each other, their heirs, entities and successors in interest from all rights and obligations contained in the Memorandum of Right of First Refusal executed by and between Triangle Plaza, LLC, a Wisconsin limited liability company and Steve Duennerman on November 25, 2003.
