Kitchens and Gabriele D. Kitchens, husband <br /> and wife, hereinafter called the Subdividers, as o�mers of a tract of <br /> land comprising, a11 of Lot thle (1) , Gommerce Subdivision, situated in <br /> part of the West Half of the Northwest Ouarter (W�NFT3�) of Section Twenty- <br /> eight (28) , Township F.leven (11) North, Range rline (9) �^�est of the 6th <br /> P.M. , in the City of Grand Island, Hall County, Nebraska, said tract <br /> containing 0.533 acres, more or less, desire to have subdivided as a <br /> subdivision the above described tract of land which is located within <br /> the corporate litaits of the City of Grand Island, PJebraska, and hereby <br /> submit to the City Council of such City for acceptance as provided by law <br /> an accurate map and plat of such proposed subdivision to be known as Park <br /> Subdivision, designating explicitly the land to be laid out and parti- <br /> cularly describing the lots and easements helonging to such subdivision, <br /> � with lots designated by numbers, and easements by dimensions, aad propose <br /> ; <br /> � to cause the plat of such subdivision when finally approved by the Regional a <br /> Planning Commission and the City C.ouncil to be acknowledged by such owners, <br /> certified as to accuracy of survey by a registered land surveyor, and to `k <br /> contain a dedication of the easements to public utilities. In consider- <br /> i ation of the plat of said Park Subdivision, the Subdividers hereby con- <br /> � sent and agree with the City of Grand Island, Nebraska, that they will <br /> install or provide at their expense the following improvements: <br /> ; l. Water. 47ater service to the subdivision is currently unavailable; <br /> ; <br /> � however, upon connection to the sanitary sewer service of a11 structures <br /> located within the subdivision, private wells will be authorized. Occup- <br /> ,.:i� <br /> fi ancy permits for any nek� structure located within the subdivision will not <br /> be issued until such time as all structures are connected to sanitary <br /> sewer. The Subdividers agree to connect any and all structures in said <br /> 5 <br /> ' subdivision to public water service when it becomes available to the j_�-� � ,; <br /> ,: <br /> '� individual lots therein.
