BE ST ORDAINED BY THE MAYOR AND COCNCZL OF THE CZTY OF G?tAA'D SS?.A!�D, FESFASKA: SECTION 1_ Sanitary Sewer District No. 434 oF the City oF Grand Zsland, Nebraska, is hereby created for the laying of an eight (8) inch vitri£ied clay pipe or polyvinylchloride plast3c pipe, and appurtenaaces thereto. SECTION 2. The boundaries of such sanitary sewer district shall be as :ollows: Beginning at the intersection of the south line of Seedling Mile Road and the west line of Wainwright Street; thence runnin� south on the west line of Wainwright S ueet and its south o-_olongation to the south line o£ Gregory Avenue; thence rvnninp west on the south line of GreQory Avenue co a line 137.58 £eet (41.934 meters) west of and oara11e1 to the south prolongation oF the west line of Villa �'ar Dee Subdivision; thence running north on a line parallel to and 137.58 feet (41.934 meters) west of the south �rolongation of the west line oP Villa Mar Dee Suodivision and continuing north oa a ?ine parallel to and 137.58 feet (41.934 meters) west of the west line of Vi21a Piar Dee Scbdivision. to the south line of Seedling :Tile Road; thence running east on the sou[h line oP Seedling Mile Road to the wesc i:ne of 'r:ainwrzght Street, bein� the point of beginning, as show�n on the plat marked Exhibit "A" dated 2/23/78 a:tached kereto and incorporuted herein 5y re£erence. SECTZON 3. Said improvement shall Se made in accordance with plans and snecifications prepared by the Engineer for the City who shall estimate the coat thereof, and sabmit the same to the city council, and, npon approval a£ the same, Sids £or the construction of such �i " sanitary sewer shall be taken and contracts eatered into in the �anner provided by 1aw. ' SECTION 4. The cost o£ construction o£ such improvements sha11 be assessed against the • property within the district abutting upon the easement or other ri�ht-of-way within which auch sanitary sewer main wi11 be constructed within such sewerage d±strict to the extent o£ bene£its to such property by zeason o£ such improvement, and a special tax shall be levied at one time to pny £or such cost o£ construction as soon us can be ascertained, ss ?rovided by law; and, provided further, such special tax and assessmencs sha11 constitute a siak±ng fund for the payment of any boads with interest, issued £or the purpose o£ paying the cost of suc:z sewer in such distr:.ct; such special assessnents shall be paid and colleczed in a fund to be designated and known as a Sewer anfl Water Extension Fund, and, out oF which a11 warrants issued for the purpose of paying the cost of such sanitary sewer shall be paid. SECTZON 5. That this ordinance, with the attached plat, is hezeby d3rected to Se £iled 3n the office oP the Register of Deeds, Ha1Z County, Nebraska.
