RAPP, husband and wife, <br /> hereinafter re£erred to as "RAPP", whether one or more, are the x <br />� owners of - �s <br />°? Lot Four (4) in Jones Addition to the City of <br /> Grand Island, Hall County, Nebraska; and <br /> WFiEREAS, EARL H. BOERSEN and DONNA J_ BOERSEN, husband and <br />� wife, hereinafter referred to as ��BOEF2SEN��, whether one or more, - <br />' are the owners of - <br />' Lot Five (5) in Jones Addition to the City of <br />' Grand Island, Aall County, Nebraslca; and <br /> i <br />' WHEREAS, said Iots adjoin each other and a common driveway <br /> exists_ for t'tie purpose of providing access to a garage that is <br /> located on the Westerly portion of Lots Four (4) and Five (5) in <br /> Jones Addition; and <br /> WHEREAS, the parties desire to enter into an easement agree- <br /> ment pertaining to easement rights for ingress and egress purposes, <br /> together with an agreement for the continued maintenance of the <br /> joint and common driveway and garage_ <br /> NOW, THEREFORE, in consideration of the mutual promises !. <br /> hereinafter contained, the parties agree as follows: <br /> l. R.APP hereby grants to BOERSEN an easement over and across <br /> t'tiat part of the Southerly portion of Lot Four (4) in Jones Addi- <br /> tion to the City of Grand Ssland, Hall County, NebrasJca whereon <br /> a joint driveway exists for the purpose of providing ingress and <br /> egress to the joint garage located on the westerly portion of <br /> Lots 4 and 5 in said Jones Addition. <br /> 2. BOERSEN hereby grants to RAPP an easement over and across <br /> that part of the Northerly portion of Lot Five (5) in Jones Addi- <br /> tion to the City of Grand Island, Hall County, Nebras}ca whereon <br /> a joint driveway exists for the purpose o£ providing ingress and <br /> egress to the joint garage located on the Westerly portion of <br /> Lots 4 and 5 in said Jones Addition. <br /> 3_ Each party hereto agrees to permit the other to use ttie <br /> joint driveway without interruptions, and each a3rees to not block <br /> the joint driveway witY► vehicles or other objects so that the other <br /> party is unable to effectively use the joint driveway. <br /> 4_ Each party hereto agrees to maintain, at his expense, that <br /> portion of the joint driveway located on his premises in a good <br /> state of repair. <br /> 5. Since a joint garage exists on the Westerly portion of <br /> Lots 4 and 5 in- Jones Addition, each party hereto agrees to maintain, <br /> at his expense, that portion of the garage which i_s situated upon <br /> his premises. The party-wall in the garage shall be maintained at <br /> the joint expense of both parties. Each party agrees to confer with <br /> the ot2zer concerning any repairs and maintenance that need to be <br /> made in order that uniform improvements will be made when necessary. <br /> 6_- This Agreement shall run wit2z the land and shall be bind- <br /> ing upon the parties hereto, their respective personal representatives, <br /> heirs, dexisees, legatees, successors nd assi� . <br /> J <br /> � er W.
