<br /> Clarence I. Hoffman and Carolyn L. Hoffman and James J. Kitten
<br /> and Aline R. Kitten, whether one or more, herein called the Mortgagor,
<br /> fand The Overland National Bank of Grand Island, Grand Island, Flall �
<br /> County, Nebraska, herein called the Mortgagee, hereby agree as follows:
<br /> 1. Mortgagor has executed and delivered to Mortgagee a first
<br /> real estate mortgage dated June 1, 1977, and recorded August 26, 1977,
<br /> at No. 77-004885 in the office of the Register of Deeds,•Hall County,
<br /> Nebraska, in consideration of the Mortgagee's certain promissory note
<br /> of $362,000.00, which is a valid subsisting obligation of the Mortgagor
<br /> and that payment of the remainder of the principal and accrued interest
<br /> thereon will be due according to the terms of the aforementioned first
<br /> real estate mortgage, Paragraph 3 will be modified and payable in the
<br /> fol]owing manner:
<br /> A note dated June 1, 1977, on which a balance of $355,966.00
<br /> remains unpaid, will be repaid in the remaining 118 payments of
<br /> the original 120 pa�yments of $3,017.00 principal plus accrued
<br /> interest on the 5th day of each month. Payments on this note
<br /> began on Septerr�er 5, 1977, and the note will mature August 5, '
<br /> 1987. The interest rate on this note is 1�% above the prime
<br /> interest rate of the Overland National Bank, adjusted annually
<br /> from the date of the note_
<br /> 2. All other terms and conditions contained in the original first
<br /> real estate mortgage dated June 1, 1977, shall remain the same, and this
<br /> Modification Agreement is made a part of the original first real estate
<br /> mortgage by reference and shall inure to all successors and assigns and
<br /> their hei rs.
