<br /> 1. 'My name is Mary A: Rowley but I am also known and called "Mae Rowley"
<br /> and "May Rowley."
<br /> 2. On February 28, 1948, my brother, James Leo Caveny, a single man,
<br /> executed and acicnowledged a Warranty Deed intending to convey to me the
<br /> following described real estate situated in Hall County, Nebraska:
<br /> 2.1 West Dne Half of the Northwest Quarter (W� NW'�) of Sect.ion
<br /> Sixteen (16) , Township Ten (10) North, Range Eleven (11} West
<br /> of the 6th P.M, in Hall County, Nebraska.
<br /> 2.2 An undivided one-half interest in the South Half of the
<br /> Southeast Quarter (S'� SE'�) of Section Thirteen (13) , Township
<br /> Ten (10) North, Range Twelve (12) West of the 6th P.M. in
<br /> Hall County, Nebraska, containing 66 Acres.
<br /> 2.3 An undivided one-half interest in the West Half of the North
<br /> Half of the Southwest Quarter (W� N'� SWa) of Section Sixteen
<br /> (16) , Township Ten (10) North, Range Eleven (11) , West of tYie
<br /> 6th P.M. in Hall County, Nebraska.
<br /> 3. The Warranty Deed described in Paragraph 2 of this Affidavit was
<br /> personally delivered to me by my brother, James Leo Caveny, in
<br /> September, 1977, when he handed me the Deed at my residence in Wood
<br /> River, Hall County, Nebraska.

<br /> p 4_ In the Warranty Deed described in Paragraph 2 of this Affidavit the
<br />; undivided one-half interest in the West Half of the North Half of the �-
<br /> y Southwest Quarter (W� N� SW%t) of Section Sixteen (16) , Township Ten
<br /> (10) North, Range Eleven (11) West of the 6th P.M. in Hall County,
<br /> Nebraska, was described as: ^One-half (1/2) interest in West Half
<br /> (W 1/2) of North Hal£ (N 1/2) of South West Quarter (S W 1/4) in Wood
<br /> River Township. 40 Acres in all.", and I accepted the Warranty Deed
<br /> from my brother, James Leo Caveny, and he delivered the Warranty Deed
<br /> to me, intending to convey to me an undivided one-half interest in the
<br /> i West Half of the North Half of the Southwest Quarter (W'� N'� SW�) o£
<br /> Section Sixteen (16) , Township Ten (10) North, Range Eleven (11) , West
<br /> of the 6th P.M, in Hall County, Nebraska, notwithstanding the incom-
<br />, pleteness of the description caused by a scrivener's error.
<br /> 5. This Affidavit is executed and is to be £iled of record together witYi
<br /> the Warranty Deed described in Paragraph 2 of this Affidavit for
<br /> properly describing and identifying that part of the real estate in the
<br /> Warranty Deed which should have been descsibed as an undivided one-half
<br /> interest: in the West Half o€ the North Ha1f of the Southwest Quarter
