� � <br /> � 7s- ��10682 <br />� EASEMENT AGREEMENT <br /> 1. Parties of first part are Wayne Cornelius and Wesley <br /> Cornelius, d/b/a Cornelius Farms, Route 1, Alda, Nebraska. <br /> 2. Parties of the second part are Robert L. Boeka and <br /> Sharyn E. Boeka. <br /> 3. Parties of the First Part are the owners of real <br /> estate located in and being a part of the Southwest Quarter (SW�j <br /> and part of the Southeast Quarter (SEi) of Section Six (6), <br /> Township Ten (10) North, Range Ten (10) West of the 6th P. M. , <br /> Hall County, Nebraska, located south of the Union Pacific Right- <br /> of-way, as more specifically described in a deed recorded in <br /> 77-001733 of the deed records in the office of the Register of <br /> Deeds f or Hall County. <br /> 4. Parties of the Second Part are the owners of real <br /> estate located in and being all that part of the Southwest Quarter <br /> (SW�t) of Section Six (6), Township Ten (10) North, Range Ten (10) <br /> West of the 6th P. M. , in Hall County, Nebraska which lies North <br /> of the right-of-way of the Union Pacific Railroad Company right- <br /> of-way excepting therefrom the folLowing tracts of ground as the <br /> same are on file in the office of the Register of Deeds, Hall <br /> County, Nebraska in deed records, recorded in Book 122, page 525 <br /> and Book 177, page 349. <br /> 5. Drainage from the above-described real estate owned <br /> by Second Parties is to the east across land also located in the <br /> Southwest Quarter (SW�) of said Section Six (6) adjoining that <br /> owned by Second Parties after which it drains easterly for several <br /> hundred feet in the road ditch north of Highway 30 (which is part <br /> • of the Southeast Quarter (SE�) of said Section) to a point where <br /> culverts presently exist under Highway 30 and the Union Pacific <br /> tracks permitting the drainage of water from the land owned by <br /> Second Parties and others unto the land owned by First Parties <br /> � in that portion of the Southeast Quarter (SEZ) located south of <br /> the Union Pacific Railroad Right-of-Way. <br /> 6. Parties of the First Part have constructed a drain <br /> including ditches and dikes approximately 2900 feet long across <br /> their land located in the Southeast Quarter (SEx) of said Section <br /> Six (6) and have spread dirt in low areas to facilitate and im- <br /> prove drainage of water coming upon their land from north of <br /> Highway 30 and the Union Pacific Railroad Right-of-way as well <br /> as draina�e otf their own land in said Section Six (6) . <br /> 7. In consideration of the payment of the sum of Nine <br /> - Hundred Ten Dollars ($910.00) representing a part of the cost <br /> of constructing and improving the drainage facilities above des- <br /> cribed, paid by Second Parties to First Parties, receipt whereof <br /> is hereby acknowledged, Second Parties are hereby granted a per- <br /> petual right and easement for the drainage of all runoff water <br /> f.cm �h� 1a..0 uwneu uy ii in :;ection Six (6), above described, <br /> and flowing with other drainage water through the culverts under <br /> Highway 30 and the Union Pacific Railroad tracks, and over and <br /> across the land of First Parties.
