KIEL and SUSAN K. � <br /> KIEL, jointly and severally, herein called the rlortgagors, in con- <br /> sideration of One Hundred Thirty-f.ive Thousand and No/100 Dollars <br /> ($135,000.00) do hereby mortgac7e to �JACY. B. VOSS and WILNL� VOSS� or <br /> the survivor of them, herein called the MortgagePs, the-followinq <br /> described real estate in Hall County, and State of rtebraska: <br /> Lots Five (5) and Six (6) in Block Two (2) <br /> in Spaulding and Gregq's Addition to the <br /> City of Grand Island, Hall County, Nebraska. <br /> And the Mortgagors do hereby covenant with the Mortgagees and <br /> with Mortgagees' heirs and assigns that Mortgagors are lawfully <br /> seized of said premises, that they are free from encumbrance, that � <br /> Mortgagors have good right and lawful authority to convey the same, <br /> and that Mortgagors warrant and will defend the titl@ to said premises <br /> against the lawfuZ claims of all persons whomsoever. <br /> This Mortgage is given to secure the payment of the principal <br /> sum of $135,000.00 and interest thereon, according to the terms of a <br /> certain, Promissory Note of even date, executed by the Mortgagors to <br /> the Mortgagees, due the lOth day of February, 1993. <br /> The Mortgagors further agree to maintain insurance upon the <br /> above described premises in an amount not less than the indebteciness <br /> , due the Mortgagees with a loss-payable clause in favor of Dtortgagors <br /> and Mortgagees as their interests may appear. The Mortgagors aqree <br /> to pay all taxes and assessments upon said premises and all other <br /> taxes, levies and assessments levied upon this Mortgage and the 1Vote <br /> • which this Mortgage is given to secure before the same become delin- <br /> quent. In the event the Mortgagors shall fail to obtain such insurance <br /> or pay such taxes be£ore delinquent, the Mortgagees may purchase <br /> such insurance and pay such taxes or other liens and shall have a <br /> lien secured hereby for the amount so advanced with interest thereon <br /> at the rate of eleven per cent (11$) per annum. <br /> In the event of default in the performance of any of the terms <br /> and Condition� of this Mortqage w- the Not� secured by it, the <br /> Mortgag�es shall be entitled to immediate possession of the property <br /> above described and all the rents, revenue and income derived there- <br /> from during such time as the Mortgage indebtedness remains unpaid <br /> shall be applied by the Mortgagees to the pa,yment of the Note and <br /> all other sums aecured hereby after deduction of any necessary costs <br /> of collection. <br /> The Mortgagors further agree that payment hereunder shall he <br /> made to Mortgagees as joint tenants and in the event of the deatYi of <br /> either of said rlortgagees, all payments due hereunder shall be made <br /> to the survivor of them who may e::ecute and deli.v�r a zelease hereo� <br /> which shall extinguish the interests of all Mortgagees hereunder_ <br /> Signed this _� qay of , 1978. <br /> � �C=.%..�.s <br /> Curtis K.
