<br /> SECTIOfI 1. That part of Evans Street, lyinR between the westerly line of Block
<br /> Thirteen (13) in Evans Addition and the easterly line of Block Fourteen (14) in Evana
<br /> Addition, £rom the northerly line of Fourth Streec to the east riRhc-of-way line o£ the
<br /> Union Pacific Railroad Company Ord Branch, crossing said Evana Street diagonally, be, and
<br /> hereby is, vacated; provided and conditioned, that the City of Grand Island hereby reservea
<br /> public utility easements as follows:
<br /> Public lJtility Easemenes
<br /> A tract of land being part of said vacated Evans Street, sixteen (16) feet,
<br /> or 4.877 mecers, in width, and a mean 1enRth of £orty-two (42) feet, or 12.802
<br /> meters, more or less, of the westerly prolonRation of the alley in Slock
<br /> Thirceen (13) of F.vans Addition from che westerly line of said Block Thirteen
<br />, (13) of Evans Addicion [o the east right-of-way line of che Union Pacific Railtoad
<br /> Company Ord Branch, crossing said vacated Evans Screet, concaininR 672 square
<br /> _ feet, or 62.429 square meters, more or less; and that part of said vacated
<br /> Evans Street beinR the westerly twenty (20) feet, or 6.096 meters, of the
<br /> easterly thircy-two (32) feet, or 9.7536 metere, from the northerly line of
<br /> Fourth Street co a line one hundred thirty-two (I32) feet, or 40.234 meters,
<br /> � northerly of and parallel to the norchezly line of Fourth Streec, containing
<br /> 2,640 square feet, or 804.672 aquare meters, more or leas; said easements co
<br /> be used to construcc, operate, maintain, extend, repair, and replace water maina,
<br /> sanitary sewers, storm sewers, manholes, overhead and underground electric
<br /> distribution lines and poles, telephone lines and poles, and other appurtenances
<br /> cotuiected therewith, ia, upon, over, underneath, and through said easements,
<br /> together with the riRht of ing,ress and eRress through and across the easements
<br /> for the exercising of the rights herein granted. No improvementa, structures,
<br /> or buildings of any kind whatsoever shall be allowed in, upon, or over the
<br /> easemen[s herein retained. The foregoing portion of vacated Evans Street,
<br /> including the area retained for public utility easements, concains 12,520 square
<br /> feet, or 1,163.108 square meters, more or less, all as shown on the drawinq
<br /> marked Exhibit "A" dated 1/8�78 attached hezeto and incorporated herein by
<br /> reference.
<br /> SECTION 2. That the title to the street vacated by Section 1 of this ordinance ahall
<br /> revart to tha osmar or ownare of lot• or landa abutting tha eama in propoztion to raapactivo
<br /> . ownershipa o! auch lota or grounde.
<br /> � SECTZON 3. That this ordinance is hereby directed to be filed ia the office of the
<br /> 8eg�,iater of Deeda, Hall County, Nebraska.
<br /> SECTZON 4. This ordinance shall be in force and take effect from and a£ter its passage
<br /> . and publication within fifteen days in one isaue of the Grand Island Daily independeat,
<br /> without the plat, as provided by law.
