<br /> ' Ai In the event of any such condemnation or taking the � I
<br /> �3 Lessee shall within 90 days after the termination date therefor

<br /> � � ( a ) Option A--.R,�e ai�rs and Im� rovements . The Lessee �
<br /> � may elect to use the Net rP oceeds of the award made in connection
<br /> ,�; with such condemnation or taking for repairs and improvements
<br /> ;� to the Hospital Fac111ty . In such event , so long as the Lessee ;
<br /> �j is not in default hereunder , the Lessee shall have the right to
<br /> ;� receive such Net Proceeds from the Trustee from time to time upon
<br /> _� the receipt by the Trustee of :

<br /> t,� ( 1 ) the Written Request of the Lessee executed
<br /> � by its President or any Vice President � ointly with its �
<br /> :a Treasurer or any Assistant Treasurer thereof specifying %
<br /> " z the expenditures made or to be made or the indebtedness �

<br /> ,,� incurred in connection �aith such repairs and improvements �
<br /> ` ;g and stating that such Net Proceeds , together with any of
<br /> ' the moneys le �ally available Tor such purposes , will be �
<br /> .� sufficient to complete such repairs and imnrovements ; and '

<br /> ,;s ( 2 ) if such Net Proceeds exceed $ 250 , 000 in amount ,
<br /> 1 the written aporoval of such Request by an Independent
<br /> '-0 Architect .
<br /> 3 The Lessee agrees to apply any such Net Proceeds
<br /> '� so received solely to the purposes specified in such
<br /> , � 4lritten Request .

<br /> }; ( b ) Ootion B--Prepayment of Rent . The Lessee may elect
<br /> � to have the Net Proceeds payable as a result of condemnation applied
<br /> r� to the prepayment of the rent payable hereunder . In such event the
<br /> `�R Lessee shall , in its notice of election to the Trustee , direct the
<br /> ' Trustee to deposit such P:et Proceeds , rrhen and as received , in the
<br /> � Optional Redemption Fund established b ,y the Indenture .

<br /> The Authority and the Trustee shall c000erate fully with
<br /> ,i , .
<br /> �` the Lessee in the handling and conduct of any prospective or pend -
<br /> r ing condemnation proceedin�s vrith respect to the Hosoital Facility
<br /> r; or any part thereof and will , to the extent they may lawfully do so ,
<br /> >' permit the Lessee to litigate in any such �roceedin� in the name
<br /> 'i� and behalf of the Authority . In no event will the Authority
<br /> y2 voluntarily settle , or consent to the settlement of , any prospective
<br /> ', or pending condemnation proceedings with resoect to the Hospital
<br /> � Facility or any part thereof without the written consent of the
<br /> 'i Lessee .
<br /> �� Section 6 . 3 • Other Provisions with Respect to Net Proceeds .
<br /> The Net Proceeds of any insurance or condemnation award received
<br /> � by the Authority and the Trustee , shail , at the request of the
