Indemniflcation of the Authority . The �� <br /> � � Lessee agrees to indemnify and save harmless the Authority and , <br /> '.,`; the Hospital Facility against any and all losses , in,� uries , claiins , <br /> ' ;'j damages or in� uries to persons or property , demands and expenses , <br /> �� including legal expenses , of whatsoever kind and nature and by <br /> :� whomsoever made arising from or in any manner directly or indirectly <br /> 3 growing out of ( a ) the use and occupancy or nonuse of the Hospital <br /> ;� Facility or any equipment or facilities thereon or used in connection <br /> � � therewith by anyone whomsoever , ( b ) any repairs , construetion , <br /> , ,,p restoration , reolacements , alterations , remodeling on or to the <br /> r� Hospital Facility , or any part thereof , or any equipment or � <br /> a facilities therein or thereon , and ( c ) the condition of the <br /> � Hospital Facility including any ad� oining sidewalks , ways or <br /> , ix alleys and any equipment or facilities at any time located thereon <br /> t �;a or used in connection therevrith . <br /> �� <br /> �r'� Section 5 . 12 . Rates and Charges . Pursuant to Section <br /> �� z3- 3 � 3 • 93 of the Act the Authority covenants that it will fix rates , <br /> R �•."� fees and charges for the use of and for the services furnished or to � . <br /> �L� be furnished by the Hospital Facility which , together with any other <br /> k revenues and receipts of the Hospital Facility , v�ill be sufficient � <br /> �i to produce gross revenues of the Lessee at least sufficient to pay <br /> " � the expenses of operation , repair and maintenance of the Hospital <br /> `�` Facility plus the rental payments required to be paid to the <br /> �9 Authority hereunder . Should the Authority fail to fix such rates ' <br /> '� fees and changes , the Lessee covenants that it will do so . ' <br /> ;i <br /> ` �,�,' ARTICLE VI ; <br /> `� Dama�;e , Destruction and Condemnation <br /> z� <br /> F;'� Section 6 . 1 . Damaae or Destruction . The Lessee agrees <br /> � ;��� to notify the Authority and the Trustee , immediately in the case <br /> -,. of dama�e exceeding $ 250 , 000 in amount to , or destruction of , the <br /> i Hospital Facility resulting from fire or other casualty . Zn the <br /> ��� event any such damage does not exceed $ 250 , 000 , the Lessee will <br /> ��' forthv: ith repair , reconstruct and restore the Hospital Facility <br /> `'� to substantially the sarie condition as it existed prior to the <br /> , .� event causing such damage and will apoly the Pdet Proceeds of any <br /> '"� insurance relating to sucn daJnage received by the Lessee to the <br /> �, <br /> ; payment or reimbursement oi the costs of such reoair , reconstruc - <br /> �! tion and restoration .
