<br /> NOTICE OF AGREEMENT
<br /> r Notice is hereby given that there is an Agreement, �
<br /> � dated the �day of October, 1976, between United Jersey �
<br /> hiortgaqe Company, a corporation; and Mid-Continent Enterprises,
<br /> � Inc., a corporation; Milan D. Bish; and Glenn R. Wilson,
<br /> Jr., wherein for valuable consideration the parties entered
<br /> a: 'i into and imposed upon land legally described as Block Nine
<br /> , 7 (9) , Continental Gardens, an Addition to Grand Island, Hall
<br /> County, Nebraska, the following restrictions and agreements
<br /> which run with the land and bind the parties, their successors

<br /> 1. Mid-Continent Enterprises, Inc., Piilan D.
<br /> Bish, and Glenn R. Wilson, Jr., convenant and
<br /> agree that they, and .each of them, shall refrain
<br /> I' until September 15, 1977, from entering into a

<br /> o ' written or oral agreement to enter into a lease,
<br /> from entering into any leases, from entering into
<br /> - a written or oral agreement to construct, and from
<br /> commencing construction of every kind and nature
<br /> ; ; with reference to Block Nine (9) , Continental
<br /> Gardens, an Addition to Grand Island, Hall County,
<br /> Nebraska; except that (a) Mid-Continent Enterprises,
<br /> Inc., may enter into a lease agreement with a
<br /> � corporation specifically named in the Agreement
<br /> g• ,' with respect to the construction and leasing of
<br /> property for the operation of a grocery store so
<br /> long as said lease provides that sub-lessees of
<br /> said property must be specifically proved in
<br /> ,, :; writing by United Jersey; and (b) Mid-Continent
<br /> �, % Enterprises, Inc., may lease space in IIlock Nine
<br /> r (9) , Continental Gardens, an Addition to Grand
<br /> ` Island, Hall County, Nebraska, for the limited
<br /> � ' purpose of the operation of a "fast-food restaurant".

<br /> w ; 2. Until either March 15, 1978, or until the '
<br /> � ` execution of a lease agreement between United
<br /> Jersey Mortgage Company and a tenant identified
<br /> r -. primarily as a "drug store" tenant in the Grand
<br /> Island tdall, whichever event first occurs, hiid-
<br /> Continent �nterprises, Inc. , hiilan D. Bish, and
<br /> Glenn R. i9ilson, Jr., agree to refrain from
<br /> soliciting prospective drug store tenants, from
<br /> entering into a written or oral agreement to enter
<br /> 9: into a lease, from entering into any leases, from
<br /> entering into a written or oral agreement to
<br /> construct, and from commencing construction of
<br /> every kind or nature, all with reference to the
<br /> operation of a "drug store" on Block Nine (9) ,
<br /> Continental Gardens, an Addition to Grand Island,
<br /> fiall County, Nebraska; and, in adclition, to refrain
<br /> from soliciting prospective drug store tenants,
<br /> from entering into a written or oral agreement to
<br /> enter into a lease, from entering into any leases,
