<br /> Section 1401 . All of the covenanL- s , stipulations , obligations and
<br /> ugreements contained in this Mortgage shall be deemzd to be covenants , stipulations ,
<br /> obligations and agreements of the Lessor and of the Governing Body to the full extent
<br /> �' authorized or permitted by law , and all such covenants , stipulations , obligations and
<br /> agreements shall be Uinding upon the successor or successors thereof from time tu time ,
<br /> r°� and upon any officer, board , commission , authority , agency or instrumentality to whom
<br /> � or to which any power or duty affecting such covenants , stipulations , obligations ,
<br /> '� and agreements shall be transferred by or in accordance with law .

<br /> ;� Section 1403 . Except as herein otherwise expressly provided , nothing in
<br /> �' this riortgage , express or implied , is intended or shall be construed to confer upon
<br /> ;'� any person , firm or corporation , other than the Lessor , the Trustee and the holders
<br /> 'fi; of the Bonds issued under and secured hy this riortgage , any right , remedy or claim ,
<br /> � � legal or equitable , under or by reason of this Pfortgage or any provision hereoi , this
<br /> 4� Mortgage and all its provisions being intended to be and being Eor the sole and exclusive �
<br /> ';;� benefit of the Lessor , the Trustee and the holders from time to time of the Bonds ;
<br /> �' issued hereunder .

<br /> , Section 1404 , In case any one or more provisions of this Dtortgage or of
<br /> ;; the Bonds or coupons issued hereunder shall for any reason he held to be illegal or
<br /> u „ invalid , such illegality or invalidity shall not aEfect any other provision of this
<br /> ya Mortgage or of said Bonds or coupons , but this Piortgage and said Bonds and coupons shall
<br /> � n be construed and enforced as if such illegal or invalid provision had not been contained
<br /> therein . In case any covenant , stipulation , obligation or agreements contained in the
<br /> Bonds or in this Mortgage shall for any reason be held to be in violation of law , then
<br /> � such covenant , stipulation , obligation or agreement shall be deemed to be the covenant ,
<br /> ` stipulation , obligation or agreement of the Lessor to the full extent permitted hy law .
<br /> ; Section 1405 . No covenant , stipulation , obligation or agreement contained
<br /> * ': herein shall be deemed to be a covenant , stipulacion , obligation or agreement of any
<br /> � present or future member of the Governing Body or agent or employees of the Lessor in
<br /> his individual capacity , and neither the nembers of the Governing Body nur any official
<br /> ` executing the Bonds shall be liable personally on the Bonds or be subject to any
<br /> '' personal liability or accountability by reason of the issuance thereof . This Mortgage
<br /> � _ _'�:; is adopted with the intent that the laws of the State of Nebraska shall govern its
<br /> ;;� construction .
<br /> Section 1406 . The fiscal agent for the Lessor (which in the case of the Series
<br /> A Bonds is , Robert E . Schweser Company Incorporated ) shall be under no obligation to
<br /> ' : _s any Bondholder for any action that it may or may not take or in respect of anything that
<br /> it may or may not do by reason of any information contained in any reports or other
<br /> documents received by it under the provisions of this Mortgage . The i�nunities and
<br /> exemptions from liability of such fiscal agent shall extend to its directors , officers ,
<br /> shareholders , employees and agents .
