Bosselman and Elizabeth Bosselman, <br /> r�� husband and wife, are the sole owners of all of the lots situated in Bosselman <br /> ;� <br /> Subdivision, an Ad3ition to the City of Grand Island, Nebraska, and <br /> r s� <br />� j WHEREAS, it is the desire of said owners of said lots to improve such <br /> lots by encouraging the sale of lots and the use of such lots for modern, de- <br /> `i sirable and attractive commercial uses only, to prevent nuisances, to prevent <br />�zj' the impairment of the attractiveness of the property and to maintain the desired <br /> tone of the Subdivision, and thereby to secure to each site owner the full bene- <br /> fit and enjoyment of his lot, with no greater restrictions upon the free and un- <br /> � disturbed use of his site than is necessary to insure the same advantages to the <br /> �,� <br /> other site owners: <br /> "'<F NOW, THEREFORE, in consideration whereof, and in consideration of the mu- <br /> c.< <br /> - tial benefits to be derived by the owners of such lots and any subsequent pur- <br /> �'� chaser or purchasers, their heirs, administrators, executors and assigns, said <br /> ��`3 <br /> owners hereby stipulate and agree that each of the aforesaid lots in said <br /> 1 � Bosselman Subdivision shall be sold, transferred and hereafter conveyed only <br /> ' subject to the following covenants, restrictions and conditions, each and all <br /> F i <br /> t;' of which shall be and remain in full force and effect as covenants, restric- <br /> tions and conditions running with the land as follows: <br /> _�� <br /> rf 1. Buildings erected on lots in said Subdivision shall be limited to <br /> 1 stores, offices, business buildings, co�mnercial enterprises, hotels, motels, <br /> res'taurants, bars, and theaters. No building shall be used or occupied as <br /> { ; living quarters, except bona fide hotels and motels. <br /> F`� 2. When any building shall be constructed on any lot in said Subdivision, <br /> r; <br /> the owner thereof shall cause such lot to be seeded and suitably planted for <br /> 'I grass and decorative shrubs, excepting, however, such part of the area as shall <br /> ``� be constructed as and used for driveways and parking space. <br /> „3 <br /> o' — <br /> 3. No signs, billboards, or advertising devices of any kind, except <br /> those used in any subsequent sale of the property in such Subdivision, shall be - <br /> �,; placed or otherwise installed on any lot except to advertise the business <br /> carried on within Guch lot. <br /> 4. On all of Lots numbered 3 through 8, both inclusive, no buildings, <br /> signs, or any other improvements other than seeding, shrubbery, lighting fix- <br /> ;j� tures, or paving for parking lots and driveways shall be permitted or located <br /> ' on any lot nearer than fifty feet (50') to the front line of such lot, except <br /> Si <br /> as follows: <br />� a. One advertising sign per driveway shall be permitted which shall not <br /> exceed in sizel8 square feet and shall not have an overall installed height <br /> of in excess of 5§ feet. <br />� ' b. Gasoline service stations, drive-in banY.ing facilities, or any other <br />�,;;-; type o f business w hic h cus tomari ly requires de tac he d faci li ties may ins ta l l <br /> - gas pumps, detached deposit cages or other small structures on said premises <br /> without regard to the 50-foot setback required; provided, however, that the <br /> ' main building and improvements thereto shall adhere to such 50-foot secback. <br /> 5. Outside storage is prohibited unless surrounded by a sight obsuring <br /> fence or landscaping; pro��ided, however, that this provision shall not intended <br />' to prevent the display of vehicles or other assembled products which are held <br />� <br /> for sale on such premises. <br /> 6. All off-street parking areas required for any individual lots are re- <br /> quired to be hard surfaced by concrete, asphalt paving, or other similar type �j., <br /> hard surface. � �����` <br /> N �,�'' <br /> 7.
