<br /> r THIS DEED entered into this �Q—day of June, 1976, by and between
<br /> Marjorie M. Fitzpatrick, Executrix, under the Last Will and Testament
<br /> of William P. Mullen, deceased, Grantor, and David A. Zaloudek and
<br /> Darlene K. Zaloudek, as joint tenants, Grantees:
<br /> WITNESSETH, that the Grantor, being the duly appointed, qualified
<br /> and acting Executsix of William P. Mullen, deceased, unuer his Last
<br /> Will and Testament, admitted to probate in the County Court of Hall
<br /> County, Nebraska, in Estate 9444, by virtue of the power and authority
<br /> granted her under said Will, and in consideration of the sum of
<br /> Thirty Thousand Dollars ($30,000.00) , L-o her paid by the Grantees,
<br /> receipt whereof is hereby acknowledged, does by these presents grant,
<br /> bargain, sell, remise, release, convey, and confirm unto the Grantees,
<br /> and to their assigns and to the heirs and assigns of the survivor
<br /> as between them, the following described real estate, to-wit:
<br /> Lot Sixteen (16) in Block Four (4) in Ashton Place, an
<br /> Addition to the City of Grand Island, Nebraska, subject
<br /> to any easements and restrictions of record.
<br /> Together with all and singular the tenements, hereditaments, and
<br /> appurtenances thereunto belonging or in anywise appertaining and also
<br /> all of the estate, right, title, interest, property, possession, claim
<br /> and demand whatsoever, which the said Testator had in his lifetime, and
<br /> at the time of his decease, and which the said Grantor has by virtue of
<br /> the said Last Will and Testament, of in or to the above granted
<br /> premises, and every part and parcel thereof with the appurtenances;
<br /> TO HAVE AND TO HOLD the said premises with the hereditaments and
<br /> appurtenances thereof unto the said Grantees and �o their assigns and
<br /> to the heirs and assigns of the survivor as between them, forever.
<br /> Grantor for herself, her successors, heirs, executors, and
<br /> administrators covenants with the Grantees that she is lawfully the
<br /> Executrix under the Last Will and Testament of William P. Mullen,
<br /> . . , 'd'eceased; that she is lawfully seized of said premises; that said
<br /> ` � premises are iree from encumbrances, and that she has power to
<br /> � �.convey the same; that she has in all respects acted, in making this
<br /> y conveyance, pursuant to the authority granted her under the Last

<br /> ' done, made, or suffered any act, matter, thing whatsoever, since she
<br /> � was Executrix of said estate, whereby said premises or any part �

<br /> any manner whatsoever; that she will promptly complete the said
<br /> estate proceedings and will effect a release of any existing or
<br /> potential liens against these premises arising therefrom.
