<br /> THIS AEED entered into this �i " day of May, 1976, by and uetween
<br /> Marjorie M. Fitzpa�rick, �xecutrix, under the Last Will and Testainent of
<br /> William P. Dlullen, deceased, Grantor, and Davis Ranch & Farms, Inc., a
<br /> Nebraska corporation, Grantee;
<br /> WITNESSETH, that the Grantor, being the duly appointed, qualified and I
<br /> acting Executrix of William P. Mullen, deceased, under his Last Will and
<br /> Testament, admitted to probate in the County Court of Hall County, Nebraska,
<br /> in Estate 9444, by virtue of the power and authority granted her under said
<br /> Will, and in consideration of the sum of One Handred Twelve Thousand Dollars
<br /> ($112,000.00) to her paid by the Grantee, receipt whereof is hereby acknow-
<br /> ledged, does by these presents grant, barga=n, sell, remise, release, con-
<br /> vey and confirm unto the Grantee, and to its successors and assigns, the
<br /> following described real estate, to-wit:
<br /> All that Portion of the SouLh Half (S'�) of Section Ten (10) ,
<br /> Township Nine (9) , North, Range Twelve (12) West of the 6th
<br /> P.M., i.n Hall County, Nebraska, lying East of the North-South
<br /> Half-Sec�ion Line, also known as Lot One (1) and Part of Lot
<br /> Two (2) on Island and Lots Three (3) and Four (4) on Mainland '
<br /> excepting for three tracts, the complete description thereof
<br /> being set forth in three separate Deeds recorded in the Office
<br /> oE the Register of Deeds, Hall County, Nebraska, and located
<br /> as follows: In Book 22 at Page 624; in Book 178 at Page 448,
<br /> and as Document No. 76-001100.
<br /> Together with all and singular the tenements, hereditaments and appurten-
<br /> ances thereunto belonging or in anywise appertaining and also all of the
<br /> , : estate, right, title, interest, property, possession, claim and demand
<br /> whatsoever, which the said Testator had in his lifetime, and at the time
<br /> of his decease, and which the said Grantor has by virtue of the said Last
<br /> t ` Will and Te�tament, of in or to the above granted premises, and every part
<br /> and parcel thereof with the appurtenances;
<br /> TO HAVE AND TO HOLD the said premises with the hereditzinents and ap-
<br /> purtenances thereof unto the said Grantee and to its successors and assigns
<br /> i : forever.
<br /> Grantor for herself, her successors. heirs, executors, and adminis-
<br /> trators covenants with the Grantee that she is lawfully the Exec��trix
<br /> under the Last Will and Testament of william P. Mullen, deceased; that she
<br /> i .' is lawfully seized of said premises; that said premises are free from en-
<br /> = cumbrances, and that she has power to convey the same; that she has in all
<br /> respects acted, in making this conveyance, pursuant to the authority granted
<br /> her under the Last Will and Testament of William P. Mullen, deceased; that
<br /> she has not done, made, or suffered any act, matter, or thing whatsoever,
<br /> since she was executrix of said estate, whereby said premises or any part
<br /> � thereof, are, shall or may be impressed, charged, or encumbered in any
<br /> manner whatsoever; that she will promptly complete the said eatate pro-
<br /> ceedings and will effect a release of any existing or potential liens
<br /> against,these premises arising therefrom.
