<br /> THIS DEED entered into this ~I day of May, 1976, by and between
<br /> Mar�jorie M. Fitzpatrick, �xecutrix, undPr the Last Will and Testament of
<br /> Wil�iam P. Mullen,' deceased, Grantor, and �Tames D. Riley and Daniel E.
<br /> Riley, Grantees;
<br /> IWITNESSETH, that the Grantor, heing the duly appointed, qualified and
<br /> acting Executrix of William P. Mullen, deceased, under his Last Will and
<br /> Testament, admitted to probate in the County Court of Hall County, Nebraska,
<br /> in Estate 9444, by virtue of the power and authority granted her under said
<br /> Will, and in consideration of the sum of One Hundred Thiity-Nine Thousand
<br /> Dollars ($139,000.00), to her paid by the Grantees, receipt whereof is
<br /> hereby acknowledged, does by these presents grant, bargain, sell, remise,
<br /> release, convey and confirm unto the Grantees, and to their assigns, the
<br /> following described real estate, to-wit:
<br /> The North Half (N'�) of the Southwest Quarter (SW�4) ;
<br /> Lots One (1) and Two (2) on Mainland and part of Lot
<br /> Two (2) Island, all lying West of the North and South
<br /> r Half Section Line in Section Ten (10), in Township °
<br /> Nine (9) North, Range Twelve (12), West of the 6th
<br /> P.M. in Hall County, Nebraska
<br /> Together with all and singular the tenements, hereditaments and appurten-
<br /> ances thereunto belonging or in anywise appertaining and also all of the
<br /> estate, right, title, interest, property, possession, claim and demand
<br /> whatsoever, which the said Testator had in his lifetime, and at the time
<br /> of his decease, and which the said Grantor has by virtue of the said Last
<br /> Will and Testament, of in or to the above granted premises, and every part
<br /> and parcel thereof with the appurtenances;
<br /> ? ` TO HAVE AND TO HOLD the said premises with the hereditaments and ap-
<br /> purtenances thereof unto the said Grantees and to their assigns forever.
<br /> Grantor for herself, her successors, heirs, executors, and administra-
<br /> tors covenants with the Grantees that she is lawfully the Executrix under
<br /> the Last Wi11 and Testament of William P. Mullen, deceased; that she is
<br /> k lawfully seized of said premises; that said premises are free from encum-
<br /> brances, and that she has power to convey the same; that she has in all
<br /> respects acted, in making this conveyance, pursuant to the authority granted
<br /> ; her under the Last Will and Testament of William P. Mullen, deceased; that
<br /> she has not done, made, or suffered any act, matter, or thing whatsoever,
<br /> since she was executrix of said estate whereby said premises or any part
<br /> ; '. thereof, are, shall or may be impressed, charged, or encumbered in any
<br /> manner whatsoever; that she will promptly complete the said estate pro-
<br /> �;_ ceedings and will effect a release of any existing or potential liens
<br /> against these premises arising therefrom
