<br /> r � � It is ' further mutually understood and agreed by and
<br /> ; �� betwean the parties hereto as follows , to-wit :
<br /> t 1 . John Cler and Est�er Cler represent that _ they have
<br /> tully complied with tha� Agreement dated November 18 , 1963 , by
<br /> and between themselvas and George 3tanek and Viola Stanek , �nd
<br /> zn: connection therewith made the recited down payment to the
<br /> said` �eorge Stanek and Viola Stanek of Ten. Thousand Dollars
<br /> (� 10 ', 000 . 00 ) and on March 1 , ; 1964 , paid to tho said Staneks
<br /> the sum` of Thirty Thousand Dollaxs ($ 30 , 000 . 00 ) and subsequently
<br /> on March 1 , 1965 , March l , 1966 , and . tdarch 1 , 1967 , have paid
<br /> the � sums of Three Thousand Dollars (3� 3 , 000 . 00 ) each year and in
<br /> ; adcli tion thareto have paid all of the interest on the primary
<br /> obligation when due and as due and payable , and that on thi �
<br /> date there is the amount of One Hundred Forty- five Thousand
<br /> Aollars ($ 145 , 000 . 00 ) plus interest at fivE per cent ( 5°� ) per
<br /> annt� fzom Pdarch l , 1967 , due the said George Stanek and -Viola
<br /> Stanek pursuant to such agreement .
<br /> The said John Cler and Es �her Cler shall make the pay-
<br /> ment of Six Thousand Dollars (�b6 , 000 . 00 ) which will be due
<br /> and payable on March l , 1968 , pursuant to such Agre �nent with
<br /> the said Staneks and . shall pay all interest on such obligaiion
<br /> up to the : date of b7arch 1 , 1968 , and the said John C1er and
<br /> Esther Cl�r shall make the payment of Six Thousand Dollars
<br /> {� 6 , 000 . 00 ) which will be due and payable on March 1 , 1969 ,
<br /> pursuant to suc.h Agreement with . the Staneks and shall pay
<br /> all interest on such obligation up to the date of March l ,
<br /> 1969 , and the said John Cler and Esther Cler shall fully
<br /> comply with the terms of the said Agreement as required by
<br /> them up to Trlarch l , 1969 , the date when it is agreed the
<br /> Parties of the Second Part shall assume all further liability
<br /> for the performance of ths contract between John Cler and
<br /> Esther Cler and George Stanek and Viola Stanek his wife ,
<br /> dated November 18 , 1963 , as above stated . In �he event that
<br /> John Cler and Esther Cler should fail to make any of the
<br /> said payments , then Mueller shall have the right to make such
<br /> payments to the Staneks and receive credit on any amounts

<br /> � ; assume all obligations whatsoever on and after i�iarch 1 ,
<br /> 1969 , for the performance of the certain Agreement by and
<br /> between �eorge St �nek and Viola Stanek and John Cler and
<br /> Esther Cler dated November 18 , 1963 .
<br /> 3 . On and after I�iarch 1 , 1968 , John �' ler and Esther
<br /> Cler , his wifa , shall continue to occupy the said premises
<br /> in Section Five ( 5 ) and Six ( 6 ) in Township Ten ( 10 ) Nebras �
<br /> Range Ten ( 10 ) West of the 6th P . Pd . in Hall County ,
<br /> ka , however they shall occupy sucn premises only as a tenant
<br /> with 0 . G . D4ueller as the landlord on a tenant - landlord
<br /> relationship pursuant to a Lease t�qre �nent this date entered
<br /> into by and between the said Parties and executed simul-
<br /> taneously wzth this Aqreement ; HOWEVER , immediately upon
<br /> the execution of this F_greement . the said 0 . � . I�fueller
<br /> shall have the right to take - possession of a maximum of
<br /> thirty ( 30 ) acres located on either Part of the idorthwest
<br /> Quarter of Southwest Quarter ( 1tW4SWa ) and the South�aest
<br /> Quarter of the Northwest Quarter (SVJkI�fWk ) of Section
<br /> Five ( 5 ) , Township Ten ( 1D ) North , Range Ten ( 10 ) , lying
<br /> South of the Railroad right- of -way and North of the � , -
