<br /> Tt being understood and agreed that the basic element of
<br /> ` this contract is that John Cler and Esther Cler shall
<br /> ' have substantially the same farminq operation going on
<br /> dnrinq- this arop yeaz and sha1L continue to rent the same
<br /> }aasic - premisas during tho crop year ot 1968 - 1969 , and in
<br /> the event that they axe not permitted to do so , they shall
<br /> be entitled to further damages over and beyond the One
<br /> Hundxed Fifty Doilars ( SG150 . 00j per acre contemplated _
<br /> in subparaqraph 3 , above , or as provided in the lease des -
<br /> ' scribed in said subparaqr3ph 3 .
<br /> 8 . It is �uzther understood and agreed that on
<br /> blarch 1 , 1868 , the date when constructive possession
<br /> of all of the premises contemplated to be transferred
<br /> hezein shall be delivered to Parties of the Second Part ,
<br /> the said John Cler and Esther Cler , each in his and her
<br /> ofm right and as spouse of the other , shall execute
<br /> a Warranty Deed to the premises described herein located
<br /> in . Sections .I'ive ( 5 ) and Six ( 6 ) in Township Ten ( 10 ) �
<br /> North, Range Ten ( 10 ) , West of the 6th P, M. in Hall
<br /> County, Nebraska , _ to _ 0 . G . iQueller and such Warranty Dee�
<br /> shall be placed pursuant to specific esezow instructions �
<br /> rrith ,the First National Bank of Grand Island , Nebraska ,
<br /> foz delivery to 0 . G . Mueller , and with specific in - -
<br /> structions that the Deed contemplated in the Agreement
<br /> dated November 18 , 1963 , by and between George Stanek
<br /> and `Iiola Stanek and John Cler and Esther Cler , his
<br /> rrife , to be delivered to John Cler and Esther Cler , his
<br /> wife , shall be delivered to 0 . G . tdueller when he has
<br /> fnlly complied with the terms of that certain Agreement
<br /> dated November 18 , 1963 , together with addit� onal escrox
<br /> instrnctions to be mutually agreed apon by and between
<br /> the Parties of the First Part and the Parties of the
<br /> Second Part herein .
<br /> 9 . It is further agreed that on or about March 1 ,
<br /> 1968 , when constructive possession is to be given h.ere-
<br /> under , that all of the Parties to t� ��gresment Will , ,�
<br /> egecute a Notice of Contract of Sal��u y be filed of
<br /> record by Second Parties instead of this Agreement if ' �s
<br /> Second Parties shall so desire .
<br /> ' 10 . Parties of the First Part shall obtain the
<br /> Abstracts of Tit1e to the premises located in said Sec -
<br /> tions Fiva ( 5 ) and Six ( 6 ) , from the � scrow Aqent , and
<br /> have said Abstracts of Title certified to date , which
<br /> Abstracts of Title shall show marketabie title except
<br /> for easements of record in and to said premises in
<br /> George Stanek and Viola Stanek , his wife , subject to the
<br /> contractual rights herein described to John Cler and Esther
<br /> Cler , and such Abstracts of Title shall be furnished to
<br /> the said Second Parties for examination purposes by his
<br /> attorneys , and in the event that any defects of title
<br /> are found , then the Parties of the First Part shall hava
<br /> a reasonable time to correct such detects . It is specif -
<br /> ically understood and agieed , however , that there shall
<br /> only be the one duty on the part of the said Parties of
<br /> the First Part to have said Abstracts of Title eatended , �
