<br /> CORRECTION.PARTIAL RELEASE OF EASEMENT AND QUITCLAIM DEED
<br /> By Quitclaim Deed dated October 8, 1970 and Correction Quitclaim Deed
<br /> dated March 16 , 1976, by and between Burlington Northern Inc., Grantor,
<br /> and John D. Folsom and Sallie S. Folsom, Grantees, Grantor conveyed all that certain
<br /> •
<br /> # = tract, lot, piece and parcel of land located in Block 25 in Nagy's Addition to the
<br /> t; City of Grand Island and in Block 25 in Original Town of the City of Grand Island,
<br /> County of Hall, State of Nebraska, being more particularly described in said deeds.
<br /> WHEREAS, under the terms and conditions of said deeds, the Grantor re-
<br /> served unto itself, its successors and assigns, an easement as follows, to-wit:
<br /> I "ALSO RESERVING, however, unto said Grantor, its suc-
<br /> cessors and assigns, a railroad easement, including the
<br /> •y right, privilege and easement to construct, maintain, re-
<br /> pair, renew, use, operate over, replace or remove railroad
<br /> tracks, drainage facilities and appurtenances thereto in,
<br /> along, over, upon or across that portion of the premises
<br /> herein conveyed, described as follows:

<br /> As lies within 8.5 feet of the center lines of
<br /> Grantor's Tracks Numbered 13 and 8,
<br /> t to have and to hold said easement for so long as the same
<br /> is used or required for railroad purposes and until said
<br /> Grantor, its successors or assigns, shall remove all such
<br /> facilities from the said promises with the intent to aban
<br /> don said easement."
<br /> WHEREAS, Grantees have requested Grantor to release a portion of the above
<br /> • described easement and said Grantor is willing to cancel and release a portion of
<br /> said certain right for the construction, maintenance, renewal, removal and opera-

<br /> • tion thereon of railroad tracks and appurtenances thereto as hereinafter described.

<br /> NOW THEREFORE, in consideration of One and no/100 Dollar ($1.00) and other
<br /> good and valuable consideration, in hand paid, the receipt of which is hereby
<br /> acknowledged, Grantor, for itself, its successors or assigns, hereby releases from
<br /> said easement and quitclaims and conveys unto Grantees, their heirs, successors
<br /> and assigns, the following described land located in Block 25, Nagy's Addition to
<br /> the City of Grand Island and in Block 25 in the Original Town of the City of Grand
<br /> Island, County of Hall, State of Nebraska, described as follows:
<br /> That portion as lies within 8.5 feet of the center line
<br /> of Grantor's Track Number 8 as it crosses the premises conveyed •
<br /> • in said Quitclaim Deed dated October 8, 1970 and Correction Quit-
<br /> claim Deed dated March 16,1976 , in a Northwesterly and
