The overland National Bank of Grand Island , Nebraska , is <br /> 4 . <br /> hereby designated as the Escrow Agent under this Contract . All <br /> 44 fees charged by the Escrow Agent shall be paid equally by Sellers <br /> and Buyer . <br /> 2 . Upon payment by the Buyer of the purchase price in full , <br /> with all interest thereon , and upon the payment by the Buyer of <br /> xe all amounts which may be advanced by Sellers as hereinabove <br /> r'? - provided , and upon the performance by the Buyer of all covenants <br /> and conditions which , by the terms of this Contract , are to be <br /> performed by the Buyer , the Escrow Agent shall deliver the Warranty <br /> Deed and abstract to the Buyer , or his heirs , assigns , nominees <br /> or successors . <br /> 3 . It is understood that the Escrow Agent shall be liable <br /> as a depository only of the deed and abstract hereinabove referred <br /> to . No payments shall be paid to the Escrow Agent . It is understood <br /> and agreed that the Escrow Agent shall not be called upon to <br /> construe any Contract or instruments accompanying this Contract <br /> and shall be required to act only as specifically set forth herein . <br /> j = In the event of any dispute between the parties hereto , the <br /> Escrow Agent shall have the right to hold the Deed and abstract <br /> deposited hereunder until its fees and expenses , including attorney <br /> II :_ fees if required , have been paid in full ; and until a mutual <br /> agreement has been reached between the parties or until delivery <br /> is legally authorized and ordered by final judgment or decree <br /> of a Court of competent jurisdiction . <br /> VI . <br /> General Agreement of the. Parties <br /> 44 <br /> 1 . Sellers are selling as joint tenants and in the event <br /> of the death of either of them , the entire balance due shall <br /> be payable to the survivor of them as surviving joint tenant in <br /> accordance with the payment schedule set forth in this Contract . <br /> X . <br /> 2 . This Contract cannot be assigned by the Sellers or the <br /> Buyer without the written consent of the other parties . <br /> 3 . In the evnt that any part of the property conveyed <br /> hereby is condemned by any governmental authority , then Buyer <br /> shall have the sole authority and responsibility with regard <br /> to such condemnation proceedings and shall be entitled to the <br /> proceeds thereof . If necessary Sellers will at Buyer ' s expense , <br /> join in any legal action which may result from any such condemnation <br /> proceedings .
