it / 76g 000689 SUBDIVISION AGREEMENT LUPT SUBDIVISION - The undersigned, Mark J. Schuele and Phyllis A. Schuele, husband and wife, and Roger W. Luft and Donna R. Luft, husband and wife, each in his and her own right, here- inefter called the Subdividers, as owners of a tract of land described as follows: ` A tract of land comprising all of Lot Three (3), Schuele Subdivision, being situated in a part of the Northeast Quarter (NE ) of Section Twenty-six (26), Township Eleven (11) North, Range Ten (10) West of the 6th P.M., Hall. County, Nebraska, said tract containing 1.1160 acres, more or less, desire to have subdivided as.a subdivision the above described tract of lend outside the corporate limits but within two miles of the City of Grand Island, and hereby sub- rr, mit to the City Council of such City for acceptance as provided by an accurate map and plat of suchproposed subdivision to he known as Luft Subdivision, designating explicitly the land to be laid out and particularly describing the lots and easements belonging to such subdivision, with lots designated by numbers and easements by dimensions; and proposes to cause the plat of such subdivision when finally approved by the Regional Planning Commission and the City Council to be acknowledged by such owners, certified as to accuracy of survey by a registered land surveyor, and to con- 4 ;' tain a dedication of the easements to the use and benefit of the public. In consider- • ation of the acceptance of this plat of said Luft Subdivision, the Subdividers and the City of Grand Island do hereby acknowledge the Subdivision Agreement entered into by the Subdividers of Schuele Subdivision dated March 30, 1973, and filed in the Register of Deeds office of Hall County, Nebraska. It is acknowledged and agreed that all the provisions of said Schuele Subdivision are applicable to this Subdivision, shall run with the land, and shall be binding upon and inure to the benefit of the parties hereto, their heirs, administrators, devisees, legatees, successors, and assigns.
