<br /> AGREEMENT WITH REAL ESTATE CONTRACT SELLERS AND BUYERS
<br /> WHEREAS, Melinda Beberniss, (hereinafter called "Seller"),
<br /> has sold to Cleo L. Beberniss, (hereinafter called "Buyer!'),
<br /> under the terms of a certain real estate installment contract,
<br /> , the following described property situated in the State of
<br /> Nebraska, County of Hall, to wit:
<br /> The East One-Half of the Southeast Quarter (EkSEk) of
<br /> Section Seventeen (17), Township Ten (10) North, Range
<br /> Ten (10) West of the 6th P.M. Hall County, Nebraska, and
<br /> The East One-Half of the Northwest Quarter (EkNW4) of
<br /> Section Twenty-Eight (28), Township Ten (10) North,
<br /> Range Ten (10) West of the 6th P.M., Hall County,
<br /> Nebraska.
<br /> for the sum of Thirty Thousand and No/l00 Dollars, said agree- 0
<br /> ment being dated executed and acknowledged on December 21, 1971
<br /> and
<br /> WHEREAS, the Buyer proposes to obtain a loan in an amount not
<br /> to exceed One Hundred Seventy Two Thousand and No/l00 Dollars
<br /> ($172,000.00) from the Overland National Bank of Grand Island,
<br /> Nebraska, and which property will be mortgaged to the Bank to
<br /> the extent of the Buyer's interest as security in connection
<br /> with said loan,
<br /> ' NOW, THEREFORE, in consideration of the foregoing, the
<br /> Seller or his representatives, agree that she will not take any
<br /> action to regain possession of the property except through
<br /> judicial foreclosure. It is agreed by the Seller, or her rep-
<br /> resentatives and the Buyer that no legal action to rescind the
<br /> {` above-mentioned purchase contract will be commenced by either of
<br /> s. them, their assigns, or their successors in interest, without
<br /> the consent of the Bank. The Seller or her representatives,
<br /> gives her consent to the Buyer to mortgage the Buyer's interest
<br /> under the above-mentioned real estate contract. In the event
<br /> that the Seller, or her representatives, determine that judicial
<br /> foreclosure under the real estate contract is necessary to pro
<br /> tect their interest, it is hereby agreed that the Bank will be
<br /> provided thirty (30) days written notice prior to such action.
<br /> In the event of the assignment of the Seller's interest in
<br /> the said contract, the Seller agrees to give written notice to
<br /> the Bank of said assignment within ten (10) days of such assign-
<br /> ment. This agreement shall be binding upon the heirs, success-
<br /> ors, and assigns of the above-named Seller and Buyer.
