The term improvement , as used in this Agreement , means the improve - <br /> ments indicated in the Plans and Specifications . <br /> SECTION VI . TIME FOR COMMENCEMENT ' AND COMPLETION OF CONSTRUCT' _ <br /> *r1) ION . <br /> lr <br /> The construction or rehabilitation of the improvements referred to in Section <br /> ,? V shall be commenced in any event within six (6 ) months offer the date of the <br />;fir Deed , and shall be completed within twelve ( 12 ) months after that date . ETION OF CONSTRUCTION OF <br /> IMPROVFMEh11 S . <br />�,� .11 <br /> The Purchaser agrees for itself , its successors and assigns , and every successor <br /> in interest to the Property , or any part thereof , and the Deed shall contain cov - <br /> enants or' the part of the Purchaser for itself and its successors or assigns , that <br /> the Purchaser , and its successors and assigns , shall promptly begin end diligently <br /> Fcomplete the redevelopment of the Property through the construction of the improve - <br /> 1' 1rnents thereon , and that the construction 51) 011 be in any event begun and completed <br /> kwithin the period specified in Section VI . It is intended and agreed , and the <br /> Deed shall so expressly provide , that these ogreernenis and covenants shall be <br /> covenants running with the land , biriding for the benefit of the community and the <br /> Seller , and enforceableby the Seller oaoinst the Purchaser and its successors and . <br /> assigns to or of ,the Property or any port thereof or any interest therein . <br /> • <br /> SECTION VIII . CERTIFICATION OF COMPLETION . • <br /> riePromptly after completion of the construction of the improvements in accordance <br /> with this :"+ un_ ement , the Seller will furnish the Purchaser with an c; ppropriate <br /> instrument so certifying . The certification by the Seller shell be and it shall be <br /> so provided in the Deed and in the certification itself a conclusive determination <br /> of satisfaction and termination of thecovenonts in the Agreement and the Deed <br /> with respect to the abdications of the Purchaser and its successors arid assigns to <br /> construct or rehabilitate the improvements and the dates for the beginning and <br /> completion thereof . The Certification shall be in such form os will enable it to be <br /> recorded . 1f the Seller shall refuse or fail to provide the certifications , the Seller <br /> shall , within thirty ( 30 ) days after written request by the Purchaser , provide the <br /> Purchaser with a written • statement indicating in adequate detail how the Purchaser <br /> has failed to complete the construction of the improvements in conformity with the <br /> Urban Renewal Plan or this Agreement , or is otherwise in default and what measures <br /> or acts as will be necessary , in the opinion of the Seller , for the Purchaser to take <br /> or perform in order to obtain the certification . <br /> a ., .
