<br /> � WHEREAS, Brentwood Develapment Company of Grand Island, and
<br /> Herbert F: Mayer, Jr. and Katharine S. Mayer, husband and wife, are
<br /> �� ; : the owners of a11 lots in "Brentwood Subdivision", a subdivision
<br /> contained upon a portion of the South Ha1f (S�) of Lot One (1),
<br /> Section Thirty (30), and part of the Northwest Quarter (NW�) in
<br /> Section- Twenty-Nine (29), all in 'Township Eleven (11�, North, Range
<br /> Nine' (4), West of the 6th P.M. , in Ha11 County, Nebraska, aI1 as
<br /> � ` more specifically �3escribed in the plat of said subdivision as the ' "'
<br /> �' same is recorded in the office of the Register of Deeds of Hall

<br /> ' ; WHEREAS, it is the desire of the aforesaid owners of said
<br /> ' subdivision to improve "Brentwood Subdivision" by encouraging the '
<br /> ; sale of lots and the �onstruction of modern and desirable dwelling

<br /> 5 ; NOt�I, TH�EREF4R� in consiceration thQ.reof., and. o.f. the mut�ual
<br /> ; benefits to be derived by the owners of said subdivision, and any
<br /> ' .� purchaser or purchasers, their heirs, devisees, personal represen-
<br /> � � tatives, and assigns, the owners stipulate and agree that any and
<br /> #' all :lots in said subdivision sold, transferred and canveyed, shall
<br /> '' be and are subject to the following protective covenants, restrict-
<br /> i ions, and conditions, a11 of �ahictt shall run with the land, as
<br /> j follows:
<br /> B1ock One (1)
<br /> � 1. Except for Lots One through�Thirteen inclusive, and Lots
<br /> � Thirty-Five through Forty inclusive, which are designated as com-
<br /> rnercial or multi-family residential lots and 'which lots shall not
<br /> be included in or affected � these restrictive covenants, restrict-
<br /> ions and conditions, all lots in the subdivision sha11 be known_and
<br /> described as residential lots. No apartment house, duplex or tri-
<br /> ' plex sha11 be built on any lot, nor shall any basement house be
<br /> a ' built on any lot. No structure shall be erected, altered, placed
<br /> ' ° or permitted to remain on any lot other than one dwelling and a
<br /> ' private garage for not more than three cars and one out building.
<br /> i, No dwelling shall be erected for occupancy for more than one family,
<br /> nor sha11 any dwelling be used for occupancy of more than one family.
<br /> z • No commercial or business enterprise shall be conducted or operated
<br /> in said addition. No lot or lots shall be divided or split to create
<br /> � ' smaller building areas, but lots may be combined or combined and
<br /> �
<br /> divided, to establish larger building areas.
<br /> 2. All garages must accomodate at least two cars and :aust be
<br /> ' attached directly to the dwelling or connected thereto by breeze-
<br /> way or similar structure. Any out building shall be of the same
<br /> quality and material of construction as the outside finish and ra�f
<br /> of the residenCial structure and sha11 not be larger than 50 square
<br /> feet of fLoor space, with the exception of bath heuses built with
<br /> swimming pools. No build ing shall be constructed of unsightly mat-
<br /> erisls, boxes or similar lumber.
<br /> E 3. No buiLding or dwelling house shall be moved into said
<br /> ' subdivision and placed upon a lot_ No trailer, tent, garage, shack
<br /> ; or other unsightly out building st►all be used in said subdivisian
<br /> as a dwelling at any time, nor shall an_y structure of a temporary
<br /> character be used as a residence. No barns, clzicken houses, house
<br /> trailers, commercial work or sales shops, or other buildin�s for
<br /> the care and housing of £ow1, rabbits or livestack shall be placed,
<br /> ' ' maintained or used on any lot, nor shall any fowl, rabbits or ani.mals
<br /> � other than household pets be kept upon any lot and household pets ��'�`; '
