<br /> WARRANTY DEED
<br /> rl. The City of Grand Island, Nebraska, by action of its City
<br /> Council on July 11, 1977, enacted Ordinance No. 6161 which directed the
<br /> canveyance of the real estate described below and the manner and terms
<br /> thereof.
<br /> ' 2. Ordinance No. 6161 was published in the Grand Island Daily
<br /> Independent according, to law, and notice of such sale and the terms
<br /> thereof was published in the Grand Island Daily Independent for three
<br /> consecutive weeks, on Ju1y 18, Ju1y 25, and August 1, 1977, all as
<br /> required by Section 16-202, R. R. S. 1943.
<br /> 3. No remonstrance against such sale was filed with the City
<br /> Gouncil of the City of Grand Island, Nebraska, within thirty days of the
<br /> �
<br /> passage and publication of Ordinance No. 6161.
<br /> 4. Section 5 of Ordinance No. 6161 provides that if no remonstrance
<br /> be filed against such conveyance, the Mayor and City Clerk-Finance Director
<br /> sha11 make, execute, and deliver to Lofgreen and DeFreece Builders a
<br /> warranty deed for said real estate, and the execution of such deed is
<br /> hereby authorized without further action on behalf of the City CounciL
<br /> NOW, THEREFORE, the City of Grand Island, Nebraska, a municipal
<br /> corporation in Ha11 County, Nebraska, as Grantor, in consideration of
<br /> $4,375.00 received from Grantee, does hereby grant, bargain, sell, convey,
<br /> and confirm unto
<br /> LOFGREEN AND DeFREECE BUILDERS,
<br /> herein calZed the Grantee, the following described real property in Hall _

<br /> Fractional Lots Five (5) and Six (6) , all of Lot Seven (7) ,
<br /> and Lot Eight ($) , plus the westerly forty (40) feet of
<br /> ` vacated Superior Street, as vacated by Ordinance No. 5995,
<br /> enacted August 24, 1976, all in Fractional Block Fifteen
<br /> (15) , Lambert's Addition; and Fractional Lots Six (6) , Seven
<br /> (7), and Eight (8) , in Fractional Block Eight (8) , Evans
<br /> Addition, all in the City of Grand Island, Hall County,
<br /> Nebraska.
<br /> To have and to hold the above described premises, together with all
<br /> ter.ements, hereditaments and appurtenances thereto belonging unto the
<br /> Grantee and to Grantee's heirs, devisees, executors, administrators,
<br /> successors, and assigns, forever.
<br /> And the Grantor does hereby covenant with the Grantee and with
<br /> Grantee's heirs, devisees, executors, administrators, successors, and
<br /> assigns that Grantor is lawfully seized of said premises; that they are
<br /> free from encumbrance, except easements of record; that Grantor has good
<br /> ,right and lawful authority to convey the same; and that Grantor warrants
