<br /> � Merle Nicola, Trustee in Bankruptcy of Edward R. Jenkins
<br /> and Charlanne M. Jenkins, bankruptcies pending in the United
<br /> States District Court for the District of Nebraska, herein
<br /> called the grantor, by virtue of an Order of the United States
<br /> District Court for the District of Nebraska, dated August 23,
<br /> 1977, approving the sale of the real property herein conveyed,
<br /> notice of which sale was given to all known creditors of the
<br /> bankrupt, and in consideration of a credit, as of August 23,
<br /> 1977, of $100,000 against the secured indebtedness o£ the bank-
<br /> rupts to First National Bank and Trust Co. of Kearney, with the
<br /> provision that in the event that said First L7ational Bank and
<br /> �� ��'
<br /> Trust Co. of Kearney is able to sell said real property during
<br /> the pendancy of said bankruptcy proceedings, the net proceeds
<br /> of sale, after deduction of all appropriate expenses, in
<br /> excess of $100,000 shall also be credited against the said
<br /> indebtedness and shall constitute part of the purchase price
<br /> paid by said First National Bank and Trust Co. of Kearney to
<br /> said Merle Nicola, Trustee, receipt of which consideration is
<br /> hereby acknowledged, does hereby grant, convey and release
<br /> - unto First National Bank and Trust Co. o£ Kearney, the following
<br /> described real property in Hall County, Nebraska: �
<br /> Lots 1, 2, 3, 4, 5 and 6, Block One (1) , Better
<br /> Homes Subdivision, said Block One {1) being
<br /> located on and being a subdivision of Lots 4, 5,
<br /> 6, 7 and the North 38.3' oi Lot Eight (8) in
<br /> Block One (1) in William Frank Addition to the
<br /> City of Grand Island, Hall County, Nebraska
<br /> together with the appurtenances thereto, and also all of the
<br /> estate which said Edward R. Jenkins and Charlanne M. Jenkins
<br /> had at the time voluntary petitions in bankruptcy were filed ,
<br /> by the said bankrupts in the said United Sta�es District Court
<br /> for the District of Nebraska in said premises, and also the
<br /> estate which the said grantor has power to convey or dispose of
