<br /> � 1. The City of Grand Island, Nebraska, by action of its 'City �
<br /> Council on July 11, 1977, enacted Ordinance No. 6159 which directed the
<br /> conveyance o£ the real estate described below and the manner and term '
<br /> ` thereof.
<br /> 2. Ordinance No. 6159 was published in the Grand Island Daily
<br /> Independent according to law, and notice of such sale and' the terms
<br /> ;� ther,eof was published in the Grand Is7�and Dai1y Independent for three
<br /> consecutive weeks, on July 18, `Ju1y 25, and August 1, 1977, a11 as
<br /> required by Section Z6-202, R. R. S. 1943. '
<br /> 3. No remonstrance against such sale was filed with the City,
<br /> Council,of`the City of Grand Island, Nebraska, within thirt�r days of
<br /> the passage and publication of Ordinance No. 6159_
<br /> 4. Section 5 of Ordinance No. 6159 provides that if no remonstrance
<br /> he filed against such conveyance, the Mayor and City C1erk-Finance Director
<br /> sha11 make; execute, and deliver to Lewis Ward a warranty deed for said
<br /> reaT estate, and the execution of such deed is hereby authorized without
<br /> further' action on behalf of the City Council_
<br /> NOW, THEP.EFOF.E, the City of Grand Island, Nebraska, a municipal
<br /> � corporation in Hall County, Nebraska, as Grantor, in consideration of
<br /> $950:00 received from Grantee, does hereby grant, bargain, sell, convey,
<br /> and confirm unto
<br /> LEWIS WARD,
<br /> herein called the Grantee, the following described real property in Hall
<br /> County, Nebraska:
<br /> Fractional Lot Three (3) in Fractional Bloek Sixteen _
<br /> (i6) , in John W. Lambert's Addition; the westerly 26.4
<br /> feet of Fractional Lot Three (3) , and the easterly 39.8
<br /> feet of Fractional Lot I'our (4) , a11 in Fractional Block
<br /> Seven (7) , Evans Addition, 'all in the City of Grand Island,
<br /> Hall County, Nebraska.
<br /> To have and to hold the above described premises, together with all tenements,
<br /> hereditaments and appurtenances thereto belonging unto the Grantees and
<br /> to Grantee's heirs, devisees, executors, administrators, successors, and
<br /> assigns, forever.
<br /> And the Grantor does hereby covenant with the Grantee and with Grantee's
<br /> heirs, devisees, executors, administrators, successors, and assigns that
<br /> Grantor is lawfully seized of said premises; that they are free from
<br /> encumbrance, except easements of record; that Grantor has good right and
<br /> lawfui authority to convey the same; and that Grantor warrants and will
<br /> defend the title to said premises against the lawful claims of all persons
