The owner of the <br /> � lakes including all stockholders and Gienn Johnson and Sharon L . <br /> Johnson shall not be liable for any injury , death or damage which <br /> may result to persons using the lakes or any of the comRon area . <br /> Rules with regard to fishin� , hunting , and boating on Lot Twelve <br /> ( 12 ) shall be as follows : <br /> A . FISHING <br /> 1 . North Lake : Fishing laws of Nebraska shall <br /> be observed . <br /> 2 . South Lake : <br /> a ) No minnows or any type of bait fish <br /> shall be used . <br /> b ) Each lot will be en [ itled to a yearly <br /> limit of fish in total for the owner and <br /> his guests , as follows : Bass , 25 pounds , <br /> Channel Catfish , 25 pounds , Walleye , 10 <br /> pounds , Bluegill , no limit . <br /> c ) No frogs are to be taken . <br /> d ) With approval of Meadowlark Estates , Inc . <br /> other species , <� r the same species of fish <br /> may be introduced and assessment made for <br /> their purchase . <br /> B . HUNTING <br /> l . Hunting laws of Nebraska sha ll be observed . <br /> 2 . No pheasant , quail or waterfowl shall be <br /> shot at , disturbed or taken . <br /> C . BOATING <br /> 1 . North Lake : Sail and power boats may be used <br /> subject to restrictions imposed by Meadowlark <br /> Estates , Inc . <br /> 2 . South Lake : No boats of any kir.d which are <br /> propelled by any type of motor or engine or <br /> boats exceeding a length of 20 feet , with the <br /> exception of canoes , shall be permitted . <br /> Other regulations pertaining to the use of Lot Twelve ( 12 ) and the <br /> lakes thereon may be adopted by the directors of Meadowlark Estates , <br /> Inc . , and sFiall be bindinR upon the owners of all lots in the sub - <br /> division . <br /> 22 . These restrictive covenants shall run with the land and <br /> shall be binding upon all persons and parties ciaiming ownership <br /> of lots in the subdivision until October 1 , 1997 , at which tirne <br /> said restrictive covenants shall be automatically renewed for suc - <br /> cessive periods of ten years each unless changed or modified by <br /> the then owners in said subdivision . <br /> 23 . If any owner of any lot or his heirs or assigns shall <br /> violate or attempt to violate any of the restrictive covenants <br /> herein set forth , it shall be lawful for any other person owning <br /> real estate in said subdivision to prosecute such proceedings at <br /> law or in equity against the person or persons violating or attempt - <br /> ing to violate any such covenants , and to prevent him from such <br /> violation or to recover damaRes for such violations . <br /> 24 . If any covenant or portion thereof is declared unlawful <br /> or void by a court of competent jurisdiction , the remaining cov- <br /> enants , or portions thereof , shall not be affected , but shall remain <br /> in full force and effect . <br /> 25 . This agreement and faithful performance of the terms <br /> hereof shall be binding upon the successors , personal representa - <br /> tives , heirs , devisees , legatees and assigns of the owner , present <br /> and future , of any lot or lots in Meadowlark Estates Subdivision , <br /> Ha l l County , Nebra ska . „'w. <br /> 26 .
