<br /> ' of John H. Wortman, Sr., deceased, Grantor, and Charles E. Fox and Mary A.
<br /> Fox, husband and wife, as joint tenants and not as tenants in common with
<br /> right of survivorship, Grantees;
<br /> WITNESSETH, that the Grantor, being the duly appointed, qualified
<br /> and acting Executor of John H. Wortman, Sr., deceased, under the Lest
<br /> Will and Testament admitted to probate in the Count,y Court of Hall County,
<br /> Nebraska, in Estate No. 8678 by virtue of the power and authority granted
<br /> him under said WTii, and in cansideration of the scan of Twe7ve �f�ausand
<br /> & No/100 ($12,000.00) Dollars, to him paid by Charles E. Fox and Mary A.
<br /> Fox, husband and wife, as joint tenants and not as tenants in common
<br /> with right of survivorship, Edward Wortman, the dul,y appointed, qualified,
<br /> and acting Executor under the Last Will and Testament of John N. Wortman,
<br /> Sr., deceased, and pursuant to such authority as granted b,y the County
<br /> ; Court of Hall County, Nebraska, said Executor does hereby grant, bargain,
<br /> se11 and convey and confirm unto Charles E. Fox and Mary A. Fox, husband
<br /> and wife, as joint tenants and not as tenants in common, with right of sur-
<br /> vivorship, the following described real estate:
<br /> The South Half (S�) of Lot Five (5), in Block Twenty-Six (26),
<br /> in the Original Town, now Citv of 6rand Island, Ha11 County,
<br /> Nebraska; and
<br /> The Westerl,y 41.2 Feet of Lot Two (2), in Block Forty-Seven
<br /> (47), in the Original Town, now City of Grand Island, Hall
<br /> County, Nebraska;
<br /> � ' Together with all and singular the tenements, hereditaments and appurtenances
<br /> thereunto belonging or in anywise appertatning and also all of the estate,
<br /> right, title. tnterest, Qroperty, possession, claim and demand whatsoever,
<br /> which the said Testator had �n his lifetime, and at the time of his de-
<br /> cease, and which the said Grantor has by virtue of the said Last Will and
<br /> Testament, or otherwise, of, in, or to the above granted premises, and every
<br /> part and parcel thereof with the appurtenances;
<br /> TO HAVE AND TO HOLD the said premises with the hereditaments and
<br /> � appurtenances thereaf unto the said grantees and to their assigns, and to
<br /> the heirs, devisees, and assigns of the survivor as between them, forever.
<br /> Grantor for himse7f, his successors, heirs, executors, and adminis-
<br /> trators, covenants with the Grantees that he is lawfully the Executor under :
<br /> the Last Will and Testament of John N. Wortman, Sr., deceased; that he fs
<br /> lawfully seized of said premises; that said premises are free and clear of
<br /> any tien or encumbrances caused by any claim for taxes levied against the
<br /> estate of John H. Wortman, Sr. , deceased, and that he has pawer to convey
<br /> the same; that he has in all respects acted, in mak9ng this conveyance,
<br /> pursuant to the authority granted him under the Last Wi11 and Testament of
<br /> John H. Wortman, Sr., deceased; that he has not done, made, or suffered
<br /> any act, matter, or thing whatsoever, since he was Executor of said estate
<br /> whereby said premises or any part thereof are, shall, or may be impressed, f
<br /> charged, or encumbered in any manner whatsoever; that he will promptly
<br /> complete the said estate proceed9ngs and wili effect a release of any
<br /> existing or potential liens against these nremises arising therefrom.
