<br /> ° TIiIS MUTUAI. CANCELLATION'OF LEASE, made and entered into as of

<br /> and DERBY REFINIbiG COMPAT3Y, a Delaware corporation having its principal

<br /> ; ; WHEREAS, under date of the 13th day of October, 1967, Plains, Inc:
<br /> and Derby Refining Company Division of Colorado 0il and Gas Corporation
<br /> entered into a certain Lease covering the following-described real property
<br /> `
<br /> situste in the County of Ha.11, State of Nebraeka, to-wit:
<br /> Lot Six (6), Block Ten (10), H. G. Clark's Addition � `
<br /> to the City of Gzand Island, Nebraska,
<br /> which said iastrument ie recorded in Book 17 at page 215 in the real property
<br /> records of the above-named county; and
<br /> WfiEREAS, the corporate name of Colorado Oil and Gas Corporation was
<br /> � � 'chaaged to Derby Refining Companq in i976; and
<br /> i ',
<br /> WHEREAS, the parties now mutually desire to terminate said Lease.
<br /> NQW, THEREFORE, for and in consideration of the premises and of the
<br /> mutual agreement herein set forth, the parties agree that the above-described
<br /> Lease shall be terminated on and as of the 15th day of August, 1977.
<br /> IIpon such termination neither party shall have any liability ta the
<br /> � ' other under and by virtue of said Lease with reapect to any obligation which
<br /> �' � would have matured subsequent to August' 15, 1977 had the said lease not beea
<br /> termiaated.
