<br /> (Under Foreclosure of Mortgage Lien,
<br /> Doc. 66, No. 66033)
<br /> KNOW ALL MEN BY THESE PRESENTS: That, whereas in an
<br /> action in the District Court of Hall County, Nebraska, herein
<br /> First of Denver Mortgage Investors and Citibank, N.A. , (formerly
<br /> known as First National City Bank) , are Plaintiffs, and
<br /> DeveZopment Engineers, Inc. , a Nebraska Corporation, et al. are
<br /> Defendants, on May 6, 1977 at the gprin� term of said Court a
<br /> decree was rendered finding that there is due and owing to
<br /> Citibank, N.A., (formerly known as First National City Bank) ,
<br /> the sum of $738,907.57, together with interest accruing thereon
<br /> at the rate of $255.11 per day thereafter, and is a first lien
<br /> with costs of suit and the accruing costs, and, whereas it was
<br /> then and there further ordered in the said action that in default
<br /> of the payment of the sum so found due by the said Defandants
<br /> that the Sheriff of Hall County, Nebraska should cause the lands
<br /> and tenements hereinafter described to be advertised and sold
<br /> according to law to pay the same, and, whereas default having been
<br /> made therein, C. F. Headley, Sheriff of Hall County, Nebraska,
<br /> under and by virtue of the said Decree and the Order of Sale to
<br /> him duly directed, did on the first day of August, 1977, at the
<br /> Lower Lobby of the Courthouse in Grand Island, Nebraska, in Hall
<br /> County, Nebraska, having first given due and legal notice o£ the
<br /> time and place of said sale for four (4) successive weeks prior
<br /> thereto in The Grand Island Daily Independent, a newspaper printed
<br /> and in general circulation in said County of Ha11, sell said premises
<br /> at public auction to Fred M. Janisch, James Bamford and Marlyn G.
<br /> Ellermeier for the sum of $520,000, which sale was afterward at the
<br /> Spring term of said Court on August 11, 1977, examined and
<br /> confsrmed and the said C. F. Headley as such Sheriff was ordered to
<br /> convey the said premises in fee simple to the said Fred M. Janisch,
<br /> James Bamford and Marlyn G. Ellermeier.
<br /> NOW, THEREFORE, I, C. F. Headley, Sheriff of the County
<br /> of Ha11 as aforesaid, in consideration of the premises and by
<br /> virtue of the powers vested in me by law and the Decree of said
<br /> Court, do hereby give, grant and convey to the said Fred M. Janisch,
<br /> James Bamford and Marlyn G. Ellermeier, and to their heirs and
<br /> assigns, the premises so as aforesaid sold, to wit: ° '
