<br /> KNOW ALL MEN BY` TIiESE PRESENTS that LAVERNE B. NIETFELDT
<br /> and PAULETTE G. NIETFELDT, husband and wife, each in his and
<br /> her 'own right and as spouse of the other, hereinafter referred
<br /> to as Mortgagors, i� consideration of the �um af �'hirty Thousand
<br /> Five'Fivndred and No/1OOths Dollars ($30,500.00) in hand paid,
<br /> do hereby sell and convey unto JAMES H. LVHEELER, hereinafter
<br /> referred to a.s Mortgagee, the following described premises situated
<br /> in Ha12 County, 'Nebraska:

<br /> TO HAVE �1ND TO HOLD the premises above described with a1T
<br /> the appurtenances thereunto belonging unto the said Mortgagee
<br /> and to his heirs or personal representatives, forever, �rov2a�a
<br /> always, and these presents are upon the express condition that
<br /> if �he aforesaid Mortgagors, their heirs or personal representatives
<br /> sha11 pag or cause to be paid to the said biartgagee, his heirs
<br /> or personal representatives, the sum of Thirty Thousand Five
<br /> Hundred and I3o/100ths Dollars ($30,500.00) with interest thereon,
<br /> payable all according to the tenure and effect of a certain Promissory _
<br /> Note executed by LAVERNE B. NIETFELDT and PAUZETTE G. NIETFELDT,
<br /> husband and wife, and delivered to JAMES H. WHEELER on July 14,
<br /> 1977, and shall pay all taxes and assessments levied upon said
<br /> rea� estate, and keep tYie buildings on said premises insured,
<br /> then these premises tQ be void, otherwise to be and remain in
<br /> fu12 force.
<br /> The Mortgagors agree to purchase and maintair� fire and
<br /> extended insurance coverage on the real estate in the amount
<br /> of at least Thirty Thousand Five Hundred and No/100ths Dollars
<br /> ($30,500.00) . Said insurance shall name the Mortgagee as the
<br /> 2oss payee. Mortgagors shall furnish to Mortgagee a certificate
<br /> evidencing the fact that such irisurance kzas been procured and
<br /> that it is in full force and effect and further that the same
<br /> cannot be terminated without reasonable notice to the Mortgagee.
<br /> This certificate shall be obtained prior to July 15, 1977.
<br /> It is further agreed (1) That if the said Martgarrors sha11
<br /> , fail to pay such taxes or procure such insurance, th�! said Mortgagee
<br /> may pay such taxes and procure such insurance; and the sum so
<br /> advanced with interest in accordance with the said Promissory
<br /> ' Note shall be paid by said Mortqagors, and tYiis Mortgag�e shall
<br /> starad as security for the same. (2) That a failure to pay any
<br /> of said monex, either principal or interest when the same becomes
<br /> due, or failure to comply with all of the foregoing agreements,
<br /> sha11 cause the whole sum of money herein secured to become due
<br /> and collectible at once at the option of the Mortgagee.
